CHAPTER 170.

CHAP. 170

Aln act to authorise the sale of the real estate devised by the
late Doctor Clemant Smith, of Prince George's county, to
Notley Young, in trust for the use and benefit of Barbara
Young, and her infant children.

Passed Mar. 2. 1832

Section 1 . Be it enacted by the General Assembly of Ma- -
ryland, That William D. Ciagett, of Prince George's coun-
ty, be, and he is hereby appointed trustee, with authority to
sell on such terms as the orphans' court of Prince George's
county shall direct, all the real estate devised by the late
Dr. Clemant Smith, of said county, to Notly Young, of said
county, in trust for the use and benefit of Barbara Young,
and her infant children; Provided, that the said William D.
Clagett shall, before he proceeds to sell or dispose of the

security, to be approved by the said court, in such penalty
as the said court shall direct, for the faithful performance of
the trust by this act reposed in him, which bond shall be
recorded by the register of wills of said county; and the
same, or an office copy thereof, may be put in suit by any
person or persons interested in the performance of the con-

dition of the same; Provided, And be it further enacted, that
no sale made by the trustee aforesaid, by virtue of this act,
shall be good and valid, until the same is approved by the
orphans' court aforesaid.

Sec. 2. And be it enacted, That the trustees aforesaid shall,
upon the sale of the said real estate, require of the purchaser
or purchasers of the same, his or their bond or bonds, for
the purchase money, made payable to the state of Maryland,
in such penalty and with such security as the orphans' court
of said county shall direct, conditioned for the payment of
the same, to such trustee as the orphans' court may, at any
time afterwards appoint to receive and collect the money
arising from the sale of the said real estate.

Sec. 3. And be it enacted, That the said orphans' court
shall, immediately after the confirmation of the sale of said
real estate, and the receipt of said bond or bonds, appoint a
trustee, whose duty it shall be to collect and receive the
purchase money, for said real estate, in trust for the use
and benefit of said Barbara Young, and her infant children,

formance of such duties as may hereafter be required of him,
