of them shall make out, or cause to be made out a plat of
said road, and return the same to the clerk of Montgomery

county court; and the said road when so opened, shall be
thereafter deemed to be a public road, and shall be kept in

Sec. 2. And be it enacted, That the said commissioners,
or a majority of them, shall value and ascertain the damage
that may be sustained by any person or persons through
whose lands the said road may pass, and the damage so as-
certained shall be levied and assessed by the levy court of

Montgomery county, as other county charges are, and paid
over to the person or persons entitled to the same.

Sec. 3. And be it enacted, That the commissioners afore-
said, or a majority of them, be, and they are hereby author-
ised and required to employ a suitable person or persons to
superintend the labourers which may be necessarily em-
ployed in opening, straightening, and amending said roads,
Provided, the said superintendant and labourers shall receive
the same compensation, and no more than is allowed by the
levy court of said county for similar services.

Superintendance.

Sec. 4. And be it enacted, That the expenses of survey-
ing and opening that part ot said road, so as aforesaid de-
scribed, and also the expenses of surveying, straightening,
and amending the road mentioned in the act to which this
is a supplement, shall be paid by Montgomery county, and
the levy court of said county is hereby authorised and re-
quired, on receiving from said commissioners, or a majority
of them, an account on oath or affirmation, of the expenses,
including two dollars per day to the commissioners for their
services, to levy the same on the assessable property of said
county, to be collected as other county charges, and when
collected, shall be paid over to the person or persons enti-
tled to the same.

Coal Mine Rail Road Company.

Passed Feb. 29,1832.

Section 1 . Be it enacted by the General Assembly of Ma-

ryland, That Andrew Bruce, Samuel P. Smith, William
M'Mahon,Williara Ward, John Porter, Richard Beall, Moore
N. Falls, Isaiah Frost, George Hobletzell, David Shriver and
John Haye, be, and are hereby appointed commission-
