CHAP. 111

lot, or part of a lot, or the person having the care of the
same, shall refuse or neglect to level, pave, amend, or repair
the foot way in front of the same, according to the ordinance
and direction of the burgess and commissioners, or a major-
ity of them aforesaid, it shall and may be lawful for the bur-
gess and commissioners, or a majority of them, aforesaid, to
contract and agree with some person or persons on reason-
able terms, to level, pave, amend, or repair such foot ways,
and to charge the expense thereof to the owner or owners
of the property in front of which the work may be done,
and shall recover the same by distress on such property, with
costs.

General powers
granted.

Sec. 11. And be it enacted. That the said commissioners,
or a majority of them, shall have power to make all such
bye-laws, regulations and ordinances, as, from time to time,
they may deem wise, equitable and expedient, for the com-
fort, health, convenience and prosperity of the said town
and its inhabitants, for the prevention or removal of nuisan-
ces, preservation of health and suppression of vice and
immorality, within the limits of said town; for the preven-
tion of the fireing of guns or crackers, horse racing, cock-
fighting and all other such improper practices within the
limits of said corporation, and shall have power to have
an assessment made of the value of all the property within
the taxable limits of said town, and to lay an equal tax on
the same, to such amount as may, from time to time, be
deemed necessary to accomplish the purposes aforesaid,
which tax shall be collected and paid to the said commis-
sioners by the said burgess, who shall have the same power
to distrain therefor, as the collector of the public county
assessment, has to destrain for taxes; and the said commis-
sioners, or a majority of them, shall fix and allow such com-
pensation to the said burgess, for his collection of said
taxes, as under all the circumstances, they may think right,
and the said commissioners, or a majority of them, shall
have power to pass and enact all such laws and ordinances
as may be necessary, to have the present streets, lanes and
alleys graded, and the curb stones planted, and the same
paved, with the consent of two thirds of the owners of the
property fronting on the street, lane or alleys, so to be grad-
ed or paved; to establish new streets, lanes or alleys, and
to have the same graded and paved, with the consent of
two thirds of the owners of the property fronting on the
same; to keep in repair, the streets, lanes and alleys in the
said town; to compensate the burgess for any services to
be rendered by him in virtue of this act.

Limit and collec-
tion of fines.

Sec. 12. And be it enacted, That no fine or forfeiture to
be imposed by virtue of this act, shall exceed the sum of
