CHAP. 102.

Said company to
refund expendi-
tures.

Sec. 5. And be it enacted, That the said turnpike com-
pany shall, when they turnpike such road, laid out by said
company, pay to the commissioners of said counties, the
full amount of money expended in building and filling in
said bridge.

Case of vacancys'

Sec.6. And be it enacted ,That in case of the death or refusal
to act, of any of the commissioners hereinbefore appointed,
then, and in that case, the commissioners of said county,
wherein the vacancy or vacancies shall occur, shall, at their
next meeting, fill such vacancy, or, as soon thereafter as
may be convenient.

Repealing clause.

Sec. 7. And be it enacted, That the several acts of assem-
bly heretofore passed, in relation to the erection of a bridge
over the Little Falls of Gunpowder, at the Rock Ford, be,
and the same are hereby repealed.

 

CHAPTER 102.

An act to incorporate the Baltimore and Chesapeake Steam
Saw Mill company.

Company incorpo-
rated.

Section 1 . Be if enacted by the General Assembly of Ma-
ryland; That George Wadsworth, John C. Ely, Philip
Boyer, Henry Klinefelter, and Michael Klinefelter, of the
city of Baltimore, and their associates and successors, and
all such other persons or bodies corporate as may hereafter
become stockholders in, and members of the corporation
herein and hereby created, shall be and they are hereby
erected into, created and declared to be, a body politic and
corporate, by the name and style of the Baltimore and Ches-
peake Steam Saw Mill Company, and by that name shall
have succession, and may sue and be sued, implead and be
impleaded, in any court of law or equity, and may have and
make a common seal and the same break, alter and renew
at their pleasure; and the purpose, objects and business, and

the powers and privileges of the said corporation shall be,
and are hereby declared to be, the erecting, having, using
and employing, one or more steam or other boats in the
waters of the Chesapeake bay and its tributaries, in the
sawing and transporting of plank or scantling sawed by the
operation of the said company, with full power and authori-
ty to purchase, take, have and hold all such estate and proper-
ty, real estate excepted, and to perform and do all such
acts and things as may be found necessary or useful for the
aforesaid objects and purposes of the said corporation.
