CHAP. 74.
Damages.
|
of the city, the footways of which shall be of such width
as the city commissioners shall fix and determine.
Sec. 2. And be it enacted, That the mayor of the city
of Baltimore shall, on or before the first of April next, ap-
point five disinterested freeholders assessors, who, having
first taken an oath before some justice of the peace for the
city of Baltimore, to decide without favour, affection, or
partiality, shall proceed forthwith to value and assess the
damages which may be sustained by the respective owners
of the lots of ground upon which the said street shall be so
widened, and also to designate the property to be benefit-
ed thereby, taking into consideration all advantages and
disadvantages, which damages thev shall apportion amongst
the owners of the property benefited, and make return of
their proceedings, or for before the first day of June next,
including all necessary and reasonable costs and expenses
incurred or to be incurred in virtue of this law, under their
hands and seals, to the register of the city of Baltimore,
who shall file and keep the same in his oilice.

To be a lien.

Sec. 3. And be it enacted. That the damages when so
valued and assessed, from the time of the return of the pro-
ceedings as aforesaid, shall he a lien upon the property so
ascertained and determined to be benefited, until their re-
spective proportions of said damages shall have been paid.

Allowance to
assessors.
|
Sec. 4. And be it enacted, That the assessors aforesaid
shall be entitled to receive two dollars per day, as a com-
pensation for their services in performing the duties re-
quired of them by this act.

To be collect-
ed.
|
Sec. 5. And be it enacted, That the city collector of
Baltimore be and he is hereby authorised, to collect the
said damages, costs and expenses, in the same manner that
the city taxes of said city are authorised to be collected,
and in case of neglect or refusal to pay he shall proceed to
make the same by public sale of the property of the person
or persons, so neglecting or refusing, ascertained and de-
termined to be benefited as aforesaid, or so much thereof
as shall be necessary, he giving at least thirty days notice
of the time and place of such sale, previous thereto, in two
or more of the newspapers published in said city, and
when collected it shall be the duty of said register to pay
orer the same to the person or persons respectively enti-
tled to receive the same in pursuance of the provisions of
this act; and as a compensation for his services the said col-
lector shall be entitled to the same commission on the
whole amount by him collected as he now receives for col-
lecting the city taxes of the city of Baltimore.

Sec. 6. And be it enacted, That the commissioners a-
ioresaid shall remove all obstructions on that part of said
street; Provided, no removal of any improvements shall
