CHAPTER 40.
A Further Supplement to the act, entitled, An act for
the distribution of a certain Fund far the purpose
of establishing Free Schools in the several Counties
therein mentioned.

Orphans court
of Charles
county may
draw on trea-
surer.

Section 1. Be it enacted by the General Assembly of
Maryland, That the orphans court of Charles county be
and they are hereby empowered and authorised, to draw,
from year to year, on the treasurer of the western shore,
and the treasurer is hereby required to pay to their order
the proportion of the school fund to which said county is
or hereafter may be entitled.

Distribution of
Money.

Sec. 2. And be it enacted, That the orphans court of
said county shall from time to time, as such monies come
to their hands, distribute the same in the manner it has
heretofore been done, to the several commissioners of said
county, to be disposed of according to law, they the said
orphans court taking the receipts of said commissioners
therefor.

Report of ex-
penditures to
be made.

Sec* 3. And be it enacted, That the said commission-
ers shall report to the said orphans court, on the first Mon-
day in November, in each year, an accurate account of the
manner in which they have expended or disposed of said
monies, and the vouchers of their expenditures shall be on
oath, and shall be safely kept on file by the said orphans
court.

Sec. 4. And be it enacted, That if any of said com-
missioners shall prove delinquent in any of the duties in-
cumbent on them, under the law relative to their trust, or
shall in any way misapply said monies committed to their
trust, they shall be accountable to the orphans court afore-
said, in any action or actions at law in any court of jus-
tice, to be brought by and in the name of said orphans
court, for the amount of monies so misapplied by them, or
for damages, such as shall be deemed by said court proper
for such delinquency or misconduct.

Report to le-
gislature.

Sec. 5. And be it enacted, That the said orphans court
shall every year report to the legislature an accurate ac-
count of all their proceedings under this act at the com-
mencement of each session thereof, and also an account of
the number of pupils educated out of said fund, designat-
ing the age and sex.

Sec. 6. And be it enacted, That the register of wills of
Charles county shall perform all such services as he may
be required and directed by the orphans court of said
