without being influenced by favour, affection, hatred, ma-
lice, or ill-will, and that he will, in making all appoint-
ments to office, vote for such persons among those willing
to accept, as in his judgment and belief shall be the most
capable and best qualified to perform the duties of such of-
fice, which oath shall be recorded in a book to be kept for
that purpose among the records of the county court.

Sec. 3. And be it enacted, That the commissioners e-
lected or appointed as aforesaid, and their successors, shall
he, and they are hereby constituted a body politic and cor-
porate, hv the name, and style, and title of The Commis-
sioners for Talbot county, and by that name shall have con-
tinual and perpetual succession, and he capable in law of
.suing and being; sued, of making and using a corporate seal,
and of altering the same, of taking;, holding, selling and
conveying, all kinds of estates, property and effects, and of
doing all such acts as shall be necessary to the exercise of
all powers which are or shall be vested in them hv this act,
or by any other act of assembly, as fully and effectually as
corporate bodies may or can lawfully and rightfully do.

Incorporated.
 

Sec. 4. And be it enacted. That when and as soon as
the commissioners to be elected or appointed as aforesaid,
are organized, shall have taken and subscribed the oath, or
affirmation, hereinbefore prescribed, all the powers, rights
and privileges, lawfully exercised by the levy court, shall
be transferred to and vested in the commissioners; a majo-
rity of the commissioners, when so organized, shall be com-
petent to exercise all the powers, rights privileges, and
shall perform all the duties required to be performed by
the levy court; and no appointment of justices of the levy
court shall thereafter be made for Talbot county; and all
powers vested in the justices of the levy court, and vested
in the commissioners of the tax respectively, and nil the
powers lawfully exercised by, or vested in the commission-
ers of the tax respectively, and all the duties by law to be
performed by them, shall be vested in, and exercised, and
performed by the commissioners for Talbot county, when
they shall be qualified as aforesaid, and a majority of the
commissioners for Talbot county shall perform all the du-
ties of commissioners of the tax, and justices of the levy
court, for Talbot county.

Sec. 5. And be it enacted, That the commissioners a-
foresaid, shall, at their annual meeting, appoint one well
qualified, fit and proper person, to act and serve as clerk to
the commissioners as aforesaid, anrf when so appointed,
shall transact all the business, and discharge all the duties
now appertaining to the several and respective offices of
clerk to the commissioners of the tax and the justices of the
levy court, in the same manner as the clerk of the commis-
