CHAPTER 28.
An Act to abolish the Levy Court and Commissioners of
the Tax for Calvert County, and for of/ter purposes.

CHAP. 28.
Passed Jan. 31

Section 1. Be it enacted by the General Assembly of
Maryland, That from and after the passage of this act, it
shall he the dutv of the governor and council, and they are
hereby required, annually to appoint five of the best quali-
fied persons, citizens of Calvert county, to be styled The
Commissioners for Calvert county, and the persons appoint-
ed commissioners as aforesaid shall, out of their own body
elect a president; and in case of the death, resignation, re-
fusal to act, or removal out of the county, of either of the
commissioners appointed as aforesaid, the governor and
council shall at their next meeting supply the vacancy oc-
casioned by such death, resignation, refusal or removal, as
the case may be.

Sec 2 And be it enacted, That every commissioner
appointed as aforesaid, shall, before, he enters on the duties
of his office, take and subscribe, before some judge or jus-
tice of the peace, an oath, or affirmation, that he will faith-
fully, diligently and impartially, exercise the powers, and
perform the duties of commissioner for Calvert county, as
authorised and enjoined bv law, according to the best ol
his skill and judgment, without being influenced by favour
affection, hatred, malice or ill-will, and that he will, ir
making all appointments to office, vote for such persons,
among those willing to accept, as in his judgment and be-
lief shall be most capable and best qualified to perform the
duties of such office, which oath shall he recorded in a bool
to he kept among; the records of Calvert county court

Sec. 3. And belt enacted. That the commissioners ap-
pointed as aforesaid, and their successors, shall be, auc
they are hereby constituted a body politic and corpo-
rate, bv the name, style and title, of The Commission-
ers for Calvert County, and by that name shall have con-
tinual and perpetual succession, and bo capable in law of
suing and being sued, of making and using a corporate
seal, and of altering the same, of taking, holding, selling
and conveying, all kinds of estates, property and effects,
and of doing all such acts as shall be necessary to the exer-
cise of all the powers which are or shall be vested in them
bv this act, or by any other act of assembly, as fully and
effectually as corporate bodies may or can lawfully and
rightly do.
