Sec 7. And be it enacted. That the commissioners
aforesaid shall have power to fill any vacancy or vacancies
in the board of trustees which may from time to time hap-
pen from any cause whatever.

Sec. 8. And be it enacted, That this act shall not be
in operation until on the first day of January eighteen hun-
dred and thirty two.

When to be in
operation

Sec 9. And be it enacted, That all acts or parts of acts,
inconsistent with, or repugnant to, the provisions of this
act, be and the same are hereby repealed.

An Act to authorise and empower Commissioners to .
open and extend the breadth of an Alley in, Westmin-
ster, in Frederick County.

Passed Feb 25.

Section 1. Be it enacted by the GeneraJ Assembly of
Maryland, That Philip -Jones, Jacob Yingling, Isaac Shri-
ver, William Shipley, Junior, and Jacob Grove, or a ma-
jority of them, he and they are hereby appointed commis-
sioners to view an alley running from the main-street of
the town of Westminster, near David Keifer's tavern, being
the same that was heretofore laid out by an act of assem-
bly passed December session eighteen hundred and twen-
ty six, chapter one hundred and thirteen, av;d if in their
opinion the public convenience would thereby be promot-
ed, they are hereby authorised and empowered to open and
extend the breadth of said alley, in addition to its present
width, fourteen feet on the main street of said town, thence
with a straight line to the north corner of the late Jacob
Sherman's land.

Sec. 2. And be it enacted, That before the said com-
missioners proceed to discharge of the duties herein di-
rected, they shall give public notice to all persons con-
cerned, by not less than three advertisements, set up at the
most public places in said town, and be duly qualified ac-
cord in £ to law.

Sec. 3 And be it enacted, That if in the opinion of said
commissioners, or a majority of them, the public conve-
nience would thereby bo promoted by extending the breadth
of said alley, thnt then they shall award whatever da-
mages, (if any) the representatives of Jacob Sherman will
thereby sustain, which sum shall be paid by the aforesaid

Damages.
