CHAP. 154.
Opening of
street
|
any of the by-laws or ordinances for the regulation of the
said town.
Sec. 3. And be it enacted. That the said commissioners
shall also have power and authority to open a street forty
feet wide to run from Liberty-street to Commerce- street,
and to give a name thereto, and to return a plat of said
street, under their hands and seals, to the clerk ol Queen
Anne's county, who shall record the same among the re-
cords of said county, and the said street shall forever there-
after be and remain a public street, and be under the con-
trol and direction of the commissioners of said town as
public streets are.

Damages
|
Sec. 4. And be it enacted, That the said commission-
ers, or a majority of them, shall have power to assess da-
mages to any of the landholders through whose property
said street may pass, taking into consideration the advan-
tages and disadvantages resulting to said pr perly from
opening said street, and paying therefor, in such manner ns
the said commissioners may direct in an ordinance which
they are hereby authorised to pass for that purpose.

Hogs
|
Sec. 5. And be it enacted, That no hog- stye shall be
erec.ed, nor shall hogs be kept in any other manner what-
ever, within one half-mile of the hounds of said town, un-
less the owner of such hog-stye or hogs shall actually re-
side on the premises where the said hog- stye is erected, or
where said hogs are kept under the penalty of two dollars,
to be recovered of the owner thereof for every day he, she
or they, shall continue said hog-stye, or keep said hogs, af-
ter five days notice is given to remove them by the com-
missioners or their agents.

Penalties, how
to be recover-
ed

Sec. 6. And be it enacted, That all the penalties im-
posed by this act shall be recovered as directed by the
eighth section of the act of assembly to enlarge the hounds
of Centreville, and for other purposes, passed at December
session in the year eighteen hundred and twenty-three.

General issue
|
Sec. 7. And be it enacted, That if any suit or action
be commenced against any person or persons for any thing
done in pursuance of this act, such person or persons may
plead the general issue, and give this act in evidence, any
law to the contrary notwithstanding.
