judges as shall be directed from time to time by ordinance
of the corporation, the same not being inconsistent with
this act.
Sec. 5. And be it enacted, That the said commissioners
shall have full power and authority to enact and pass all
laws and ordinances to preserve the health of the town
prevent and remove nuisances; to preserve and keep free
from incumbrances the foot-ways; to grade, pave, and fix
kirb-stones uniformly, with the exception of setting up
kirb-stones in front of wagon yards in the said town of
Westminster, not exceeding on either side of the street or
streets thereof one fifth of the whole width; to impose and
appropriate fines, penalties and forfeitures, for the breach of
their by-laws or ordinances; to apportion the cost for pav-
ing foot ways, crossing alleys or streets, am0ngst the pro-
perty holders of the adjoining squares of ground in propor-
tion to the number of front feet; to open and keep open all
streets, lanes and alleys* originally laid out; all ordinances
nnd by-laws thus passed to be signed by the commission-
ers.

Powers.

Sec. 6. And be it enacted, That it shall be the duty of
the commissioners, within tea days after their election, to
give notice to the citizens of Westminster of their intention
to grade, pave, and set up kirb-stones on the foot-ways of
such part or parts, or the whole of said street or streets, as
may be by them determined, for the space of two months,
requiring of the owner or owners of property forthwith
to grade, pave and set up, kirb-stones, under their direction,
in front of their respective lots.

Sec. 7. And be it enacled, That the said commissioners,
or a majority of them, shall have power and authority to
appoint a clerk from time lo time, and to assign to him his
duties, and to allow him a salary in their discretion, not
exceeding the sum of twenty dollars; to employ, compen-
sate and dismiss, at pleasure, all such servants, horses,
carts, and otherwise, as they may deem needful or useful
in the construction of the work; to contract for and pur-
chase all such materials as may be by them required to
grade, pave and fix kirb stones, or cause to be graded, pav-
ed and fix kirb-stones, on the main-streets of Westminster,
in front of lots owned by persons who refuse, neglect or
omit, to do do so within the time limited by the by-laws,
with power and authority to charge the owner or owners,
or those having in charge and exercising ownership over
said property, with the proper cost of same, and the pro-
portion for paving cross streets and alleys, with the addi-
tional charge of ten per cent as a fine therefor, to be re-
