1874.] OF THE SENATE. 425

supposed to be in favor of Mr. Jarboe's removal, (the present
incumbent,) it is again attempted by the present bill to con-
tinue him in office for one year longer than the time for
which he was appointed, under the Act of 1872, and then to
take the appointment from the County Commissioners, where
in all justice and fairness it properly belongs.

We do, therefore, most earnestly protest, in the name of
our constituents who have elected us, against this shameful
attempt at special legislation, as tending to thwart the will
and wishes of the majority of the people, contrary to the in-
tent and spirit of our Constitution, and well calculated to
bring our laws and our government in discredit and disre-
pute.

BENJAMIN FRANKLIN DUVALL,

President.

hold his office for four years, and until his successor shall be
elected and qualified, and be re-eligible, subject at all times
to removal by the Commissioners for neglect of duty, or mis-
behavior in office."
