Kill or destroy

SEC. 2. And be it enacted, That it shall notbe law-
|
pheasant.

ful for any person to kill or destroy any pheasant

between the fifteenth day of January and the first

day of August, or snare, or in any way entrap any

pheasant during any season of the year whatsoever,

under the penalty of five dollars for each and every

pheasant so killed, taken or destroyed.

SEC. 3. And be it enacted, That it shall not be law-

day of October, under the penalty of five dollars for

each and every partridge so killed, taken or de-

stroyed.

SEC. 4. And be it enacted, That no person shall, at

or nests of any such birds as are named in this act, un-
|

der the penalty of two dollars for each and every

offence.

Evidence of
|
SEC. 5. And be it enacted, That the possession, by
|
violation
|
any person within the county, of any of the birds
|
 
|
mentioned in this act, as shot, killed, or anywise de-
|
 
|
stroyed, shall be prima facie evidence to commit un-
|
 
|
der this act.
|
 
|
SEC. 6. And be it enacted. That any person offend-
|
 
|
ing against the provisions of this act, and being
|
 
|
convicted thereof before any justice of the peace in
|

this county, or by the oath or affirmation of one or
|
 
|
more witnesses, shall forfeit the fines named in this
|
 
|
act, one-half to the use of the school fund of the
|
 
|
county, and the other half to the use of the informer ;
|
 
|
and if the offender, after being convicted of the
|
 
|
crime, shall refuse to pay the fine imposed by this
|
 
|
act, he or they shall be committed to the jail of the
|
 
|
county for every such offence for the space of ten,
|
 
|
days ; provided, however, that such conviction shall
|
 
|
be made within sixty days after committing the
|
 
|
offence.

SEC, 7. And be it enacted, That it shall be the duty
