January session of the General Assembly of Mary-

land, eighteen hundred and seventy-two, chapter
|
 
|
three hundred and eighty-seven, entitled an act to

|
repeal section four, of an act passed by the General
|
 
|
Assembly of Maryland, at its January session,
|
 
|
eighteen hundred and seventy, chapter ninety-nine,
|
 
|
entitled an act to lay off streets in Baltimore county,
|
 
|
adjoining Baltimore city, and to repeal certain acts
|
 
|
inconsistent therewith, and to re-enact the same with
|
 
|
amendments; and each of said acts just above-men-
|
 
|
tioned, and each and every section of each and every
|
 
|
act just above-mentioned, be and the same are hereby
|
 
|
repealed.

|
SEC. 2. And be it enacted, That the County Com-
|
 
|
missioners of Baltimore county may, upon the appli-
|

cation, in writing, signed by the owner or owners of

a majority of front feet of ground fronting and

binding on such proposed street, avenue or alley,

appoint three discreet tax-payers of Baltimore county,

not related to any party interested in the opening

of the proposed street, avenue or alley, not owning

property fronting or binding on said proposed

street, avenue or alley, the pay of whom shall

be two dollars and fifty cents for each and every

|
day actually and necessarily engaged ; but to whom
|
 
|
no mileage shall be allowed, who, or a majority
|
 
|
of whom, after having taken an oath before some
|
 
|
justice of the peace of the State of Maryland, in
|
 
|
and for Baltimore county, that he or they will
|
 
|
well and truly, and without prejudice or partiality,
|
 
|
assess the benefits and damages happening, arising
|
 
|
or ensuing from the opening, laying out, grading
|
 
|
and constructing of said proposed street, avenue or al-
