repealed so fur as the same relates to Baltimore city.

SEC. 2. And be it enacted, That this act shall take

effect from the date of its passage.

CHAPTER 313.
|
 
|
AN ACT to repeal and re-enact with amendments
|
 
|
the twenty-third section of the forty-first article of
|
 
|
the Code of Public General Laws, title "Fish and
|
 
|
Fisheries," sub-title "Patuxent."
|
 
|
SECTION 1. Be it enacted by the General Assembly of
|
Repealed and
re-enacted
|
Maryland, That the twenty-third section, of the forty-
|
 
|
first article of the Code of Public General Laws, title
|
 
|
"Fish and Fisheries," sub-title "Patuxent," be and
|
 
|
the same is hereby repealed and re-enacted with
|
 
|
amendments so as to read as follows :
|
Shall not stake
|
23. No person shall stake down any seine or net
|
down.
|
across the Patuxent River for the purpose of taking
|
 
|
shad or herring; nor shall any person whip, thrash,
|
 
|
or beat the waters of the Patuxent River with poles
|
 
|
or any other instruments for the purpose of driving
|
 
|
fish into any seine or net; nor shall any person in
|
 
|
fishing in the said river, between the fifth day of
|
 
|
March and the fifteenth day of May, use any seine
|
 
|
or net with meshes of less size than one and three-
|
 
|
eighths of an inch square; or during the rest of the
|
 
|
year with any seine or net with meshes of a less size
|
 
|
than two inches square, and no person shall empty
|
 
|
any seine except in water twelve inches deep ; and
|
 
|
any person violating this section shall be subject to
the fine and forfeitures provided in the twenty-second
|
 
|
section of this, article.

SEC. 2. And be it enacted, That this act shall take

effect from the date of its passage.
