SEC. 17. And be it enacted, That when no objection

No objection.

shall have been filed, within the time hereinbefore

 

designated, or if objection shall have been filed and

 

the road petitioned for confirmed by the County

 

Commissioners of said county, or if in case of appeal

 

the order of the County Commissioners is affirmed

 

by the Circuit Court for said county, the County

 

Commissioners shall record or caused to be recorded

 

such road as a public road of Baltimore county, and

 

the award if for damages, shall be paid by said County

 

Commissioners to the person or persons, or body

corporate entitled to receive the same, within ninety

 

days from the ratification of said award and report,

 

and the award if for benefits shall be considered a tax

 

and lien upon the property assessed, and shall be

 

paid to the County Commissioners or the Treasurer

 

of said county, upon the order of said County Com-

 

missioners, within sixty days from the time the award

 

and report are finally ratified and confirmed as afore-

 

said ; provided, thirty days' notice is given to the

 

owner or owners of the property taken for such road,

or to his, her, or its agent or attorney, or left upon

 

the premises in case the owner is unknown; and said

 

sum shall be applied to the purpose of paying the

 

damages, and for the construction of said road.

 

Whenever any person or persons shall desire to im-

 

prove any road to an extent beyond that contemplated

 

by the Board of Examiners, they may make appli-

 

cation to the County Commissioners, who shall issue

 

a commission to three disinterested tax payers of

 

said county, directing them to meet. upon the prem-

 

ises and examine the location and the premises set

 

forth in said application, and if they shall judge that

 

the public interest will be promoted thereby, they

 

shall direct the County Commissioners to pay towards

 

such improvement an amount not exceeding one hun-

 

dred dollars per mile, to be paid upon completion of

 

said improvement; provided, however, that said ap-

 

plicants subscribe an amount double that to be paid by

the County Commissioners. All the work of said

 

improvement shall be under the direction and con-

 

trol of the supervisors; whenever any doubt may

 

exist as to the proper location or width of any road,

 

supervisors may cause the same to be surveyed, and

 

in their discretion make such alteration as the con-
