EXECUTIVE DEPARTMENT,

To the Senate :
I return, without my signature, Senate bill No. 35, en-
titled "An Act relating to Auctioneers in Baltimore county."
This bill is objectionable for the following reasons :
1st. It is repugnant to the general policy of the State in
regard to the regulation of sales by auction.
There are but two counties, I beleive, (Allegany and Cecil,)
in which such local legislation has been permitted, and in both
counties, the law only operates in towns and in a circuit of
one mile around any town, and is restricted in its application
to persons, who shall bring into said counties, from abroad
any goods, wares and merchandize to sell at auction within
the preseribed limits, and to persons, who shall sell at auc-
tion, goods, &c., sent from abroad to be sold on commission.
2nd. It is the policy of the State, that money derived from
the issue of licenses, should be paid into the State Treasury,
while the money derived from licenses under this bill, is to be
paid t'o the Treasurer of Baltimore county.
3rd. The bill itself does not require the license to issue
annually, but apparently the Auctioneers is to take out a
license, wherever he "shall sell property of any description,
which shall exceed in value the sum of one hundred dollars."
4th. The bill does not provide, whether the fines shall be
recovered in the name of the State or of the county, nor
what shall be done with them when collected.

The Senate proceeded, as the Constitution provides, to re-
consider the said bill returned by the Governor to the Senate
with his objections.

An Act relating to Auctioneers in Baltimore County.
SECTION 1. Be it enacted by the General Assembly of Mary-
land, That no person shall sell, as auctioneer, property of any
description, which shall exceed in value tile sum of one hun-
dred dollars, without having first obtained a license from the
Clerk of the Circuit Court of Baltimore county, as auctioneer.
SECTION 2. And be it enacted. That any person applying for
a license, shall pay for the same the sum of fifty dollars,
which sum of fifty dollars shall be paid over by the said Clerk
to the Treasurer of Baltimore county.
SECTION 3. And be it enacted, That any person violating the
