CHAPTER 101.

 

AN ACT to authorize the County Commissioners of

 

Cecil county, to pay the Sheriff of said county, a

 

per diem for attendance in person or by deputy

 

upon the court, and such further compensation for

 

other services as in their discretion may seem to

 

them right and proper.

 

SECTION 1. Be it enacted by the General Assembly of

Allowance for

Maryland, That the Sheriff of Cecil county, shall be i

attendance

allowed two dollars and fifty cents for each day's at-

 

tendance in person or by deputy upon the court

 

when it is actually in session, and also that the

 

County Commissioners in the exercise of a careful.

 

wise and sound discretion, and of a scrutinizing

 

judgment, allow him such further compensation for

 

serving bench warrants and attachments, during the

 

sessions of said courts, and performing extra duty,

 

as may seem to them right and proper: provided,

 

that before they shall order to be paid to him any

with them for each case, which shall be kept in their

 

office, and shall set forth accurately and in detail, the

pensation is asked, the time consumed in performing

were necessary, and shall be verified by the oath of

 

the Sheriff, and of the deputy who performed such

 

services, and it shall be the duty of the County Com-

 

missioners, to examine carefully each petition and see

 

that the requirements of this act are strictly complied

 

with, and they shall not order to be paid, any claim

 

or extra compensation unless each and every pro-

 

vision is fully complied with, and unless ther'e is

 

annexed to each petition, an affidavit of the truth

 

of the matter in it, and that such extra services

 

were absolutely and indispensably necessary in each
case; and they, after all the requirements of this act

 

are complied with, shall then pay only such sum

 

for extra compensation as shall appear to them to be

 

a fair, reasonable and proper compensation, and
