CHAPTER 79.

 

AN ACT for the protection of Black Bass and all

 

other fish in the Patapsco River, above tide water.

 

SECTION 1. Be it enacted by the General Assembly of

 

Maryland, That from and after the passage of this

act, it shall not be lawful for any person or persons,

 

to take, capture, or destroy fish, by seine or seines,

 

dragnet or dragnets, setnet or setnets, dipnet or dip-

 

nets, stirnet or stirnets, fish baskets, or fish pots,

 

eels, weirs, brush, or fascine nets, or any means or

 

contrivances whatever of the nature of a seine,

 

which are known to destroy or capture fish, or to

 

destroy or capture them by shooting or striking

 

through the ice, or otherwise than by hook and line,

 

commonly known as angling, in the Patapsco River

 

above tide water.

 

SEC. 2. And be it enacted, "That the owner or owners

 

of all dams, erected now or hereafter, on said river,

 

shall and are hereby required to make or cause to be

made, and keep in repair, proper fish ladders, and

 

have them placed on said dam, so as to afford to the

 

fish, in said river, free course up and down said river.

 

SEC. 3. And be it enacted, That if the owner or

 

owners of the aforesaid dams fail to comply with the

 

S revisions of the proceeding section, within sixty

 

ays from the passage and approval of this act, they

or either of them shall be liable, upon conviction

 

thereof, by summary process before any justice of

 

the peace of this State, in the county nearest or ad-

 

jacent to where the dam or dams are situated, to a

 

penalty of not less than fifty nor more than one

 

hundred dollars, five dollars to the informer and the

 

balance to the board of county commissioners of the

 

counties adjacent to said dam or dams, for school

 

purposes.

 

SEC. 4. And be it enacted, That any person or per-

 

sons offending against the provisions of the first sec-
tion thereof shall be liable, upon conviction thereof,

 

by summary process before any justice of the peace
