CHAPTER 59.
|
 
|
AN ACT to add an additional section to article forty
|
 
|
of the Code of Public General Laws, entitled
|
 
|
" fines and forfeitures," to come in after section
|
 
|
three.
|
 
|
SECTION 1. Be it enacted by the General Assembly of
|

|
Maryland, That the following additional section be
|
General Laws
|
added to article forty of the Code of Public General
|
 
|
Laws, entitled " fines and forfeitures," to come in
|
 
|
after section three :
|
 
|
4. Any person who shall or may hereafter be com-
|
 
|
mitted to jail by the judgment of any court of justice,
or by any justice of the peace of this State, for non-
|
 
|
payment of any fine and costs not exceeding the sum
|
 
|
of fifty dollars, who shall have remained in custody
|

for fine and
|
as aforesaid for the space of thirty days, or any
|
costs
|
person who shall or may hereafter be committed to
|
 
|
jail in manner aforesaid for non-payment of any fine
|
 
|
and costs above fifty, and not exceeding one
|
 
|
hundred and fifty dollars, who shall have remained
|
 
|
in custody aforesaid for the space of sixty days, shall
|
 
|
be discharged from further imprisonment on account
|
 
|
of said fine and costs; prodded, such person shall
|

prove to the satisfaction of the court imposing said
|
 
|
fine and costs, or any judge thereof, or justice of the
|
 
|
peace, as the case may be, that he or she is unable to
|
 
|
pay said fine and costs.
|
 
|
SEC. 2. And be it enacted, That this act shall take
|
 
|
effect from the date of its passage.
