ceedings in the suit, to whom the judgment recovered shall

113. Any candidate refusing or neglecting to comply with the

provisions of this Act, as hereinbefore prescribed, shall be

his votes shall be counted by the return judges; and in case of

the refusal of any nominee to pay the fee hereinbefore re-

the person having the next highest vote in the convention, who
|

has paid the said fee and complied with the provisions of this

Act, shall be substituted on the ticket. If there be no nominee
|
 
|
for any of the places on the ticket, the said convention of re-
|
 
|
turn judges shall select a candidate for such place, and in the
|
 
|
event of any nominee dying or declining to have his name ap-
|
 
|
pear on the ticket the said committee shall have the name of
|
 
|
the person receiving the next highest number of votes, pro-
|
 
|
vided he has complied with all the provisions of this Act, to
|
 
|
be placed on the ballot ; and in case of a tie for any place on the
|
 
|
ballot, the return judges at said convention shall select publicly
|
 
|
by lot a nominee from among the candidates so tied. If the ex-
|
 
|
penditures for a candidate for nomination as set out in the affi-
|
 
|
davit of expenditures in this section provided for shall exceed
|
 
|
the amounts of: For Judge of the Circuit Court, $300; for
