to acquire any property located in the City of Baltimore, any

Justice of the Peace of the State of Maryland, in and for the
|
 
|
City of Baltimore, shall be authorized to issue the requisite war-
|

rant, and the Sheriff of Baltimore City shall execute the war-

rant so issued, and the return by the Sheriff shall be made to

the Clerk of the Circuit Court of Baltimore City, and said court
|

shall have jurisdiction to confirm or set aside inquisitions re-
|
 
|
turned to it, and all the provisions of law in reference to the
|
 
|
rights and powers of railroads incorporated under the General
|
 
|
Law, shall apply to the said Western Maryland Tidewater Rail-
|
 
|
road Company in the City of Baltimore to the same extent as
|
 
|
the same apply to the various counties of the State of Maryland.

|
SEC. 4. And be it enacted, That the said Western Maryland
|
Corporate
|
Tidewater Railroad Company be and the same is hereby au-
|
rights and
|
thorized and empowered to construct and operate the whole or
|
franchises.
|
any part of the lines it is entitled to construct under its charter
|
 
|
and amendments thereto, and under this Act in such order
|
 
|
as it may deem best, and to have and enjoy all the corporate
|
 
|
rights and franchises conferred by its original charter and the
|
 
|
amendments thereto including this Act as to the whole or
|
 
|
any part of said lines while the same is being constructed
|
 
|
and after the same shall be completed.
|
 
|
SEC. 5. And be it enacted, That nothing in this Act relating
to the construction of a bridge over the Middle Branch of
|
Property and
riparian
|
the Patapsco river shall be construed to deprive any person
|
rights.
|
whose property is taken therefor or whose riparian rights are
|
 
|
taken for the construction of said bridge of the right to fair
|
 
|
compensation for all injuries resulting to the same, from the
|
 
|
construction of said bridge. And provided further, that said
|
 
|
railroad company be required to acquire by purchase or con-
|
 
|
demnation the private property or riparian rights which it
|
 
|
will be necessary to take in the construction of said bridge
|
 
|
before undertaking to construct said bridge over such private
|
 
|
property or riparian rights.
|
 
|
SEC. 6. And be it enacted, That this Act shall take effect
|
 
|
from the date of its passage.
