SEC. 11. And be it enacted, That the said company be and it
is hereby authorized, in order to construct said railway on
such land or property of any individual or corporation, or on
such private right of way of any individual or corporation,
as it may be necessary to occupy in order to construct said
railway between the points authorized by this Act, and where

Arundel County, upon a warrant of some justice of the peace
of said county, to condemn said land or property, and the in-
quisition thereupon shall be signed by the sheriff and jury
and be returned by said sheriff to the Circuit Court for Anne
Arundel County, and unless good cause be shown against
said inquisition of the jury, it shall be ratified and confirmed
by the said court at the term next after the return of said in-

 

quisition, and be recorded, and upon payment of the damages
assessed by said inquisition, said company shall proceed to
occupy and possess the land or property so awarded for the
purposes aforesaid, but if said inquisition shall be set aside, said

SEC. 12. And be it enacted. That the president and directors
of said company may borrow, from time to time, for the
