not to prevent the free and convenient travel over such public
|
 
|
road, street or highway by any citizen, and provided, further,
|
 
|
that the said corporation shall keep the county road or public
|
 
|
streets occupied by them in good order, between their tracks
|
 
|
and for two feet on each side thereof, and the said corporation
|
 
|
is further authorized and empowered to acquire such right
|
 
|
of way or the use of lands as it may find needful or advanta-
|
 
|
geous to the construction and operation of such railway line
|
 
|
or lines by purchase, gift or grant, and for the purpose of
|
 
|
obtaining rights of way which may be wanted for the proper
|
 
|
construction of such railway line or lines, when said corpora-
|
 
|
tion cannot agree with the owner, or where the owner is femme
|
 
|
covert, under age, non compos mentis, or any other legal dis-
|
 
|
ability, or out of said county when said property may be
|
 
|
wanted, said corporation may proceed to condemn and ac-
|

quire the use thereof in the manner provided in Article 23

streets, or other public properties are to be used, permission

SEC. 8. And be it enacted, That said corporation, within
|
 
|
the scope of all the purposes hereinbefore mentioned, shall

have and enjoy, besides those powers and privileges in this

Act particularly enumerated, all other general powers, pro-
|
 
|
visions and privileges conferred by the general incorporation
|
 
|
laws of this State upon companies duly incorporated under
|
 
|
the same, and shall be subject to the general regulations in
|
 
|
such law, except in so far as altered by the provisions of
|
 
|
this Act; provided, that nothing in this Act shall be construed
|
 
|
to authorize the company to acquire any property by condem-
|
 
|
nation, except that which shall be necessary for the construc-
|
 
|
tion of the railroad; in every other case the said acquisition
|
 
|
shall be by purchase.
|
 
|
SEC. 9. And be it enacted, That for the term of five years
|
 
|
after the completion of said railway, or the opening thereof
|
 
|
for traffic or travel, the real and personal property of said
|
 
|
corporation, and its stocks, revenue, tolls and income, shall
|

be subject to State taxation only; and after said term of five
|
