of making said mortgage or mortgages or thereafter acquired ;

said bonds and mortgage or mortgages to be made and exe-
|

cuted in form as the directors of said company shall prescribe ;
|
|
 
|
said bonds to be payable at such time, bear such rate of inter-
|
|
 
|
est not exceeding six per centum per annum, and contain such
|
|
 
|
terms, conditions and provisions as to said directors shall seem
|
|
 
|
meet and proper, and to be issued and disposed of from time to
|
|
 
|
time upon such terms as the directors shall determine, and
|
|
 
|
as may be agreed upon ; and in case of sale made by virtue of
|
|
 
|
said mortgage or mortgages, whether under foreclosure or
|
|
 
|
other judicial proceedings, or pursuant to any power con-
|
|
 
|
tained in said mortgage or mortgages, the purchaser or pur-
|
|
 
|
chasers thereunder or pursuant thereto, or his or their sur-
|
|
 
|
vivor or survivors, representatives or assigns may, together
|
|
 
|
with associates, if any, form a new corporation in which there-
|
|
 
|
upon shall become vested all the powers, property and fran-
|
|
 
|
chises heretofore owned and possessed by said Howard Pro-
|
|
 
|
duction Company, and a certificate of the formation of the
|
|

said new corporation shall be made, executed, acknowledged
|
|

and recorded as at present certificates of incorporation are

SEC. 2. And be it enacted, That this Act shall take effect

from the date of its passage.

AN ACT to refund to Joseph G. Harrison, George A. Harrison

and J. Samuel Price, collectors of State taxes for Worcester

County, money erroneously paid by them into the State
|
|
 
|
Treasury.

SECTION 1. Be it enacted by the General Assembly of Mary-
|
|

authorized and directed to issue his warrants upon the Treas-

urer of said State in favor of Joseph G. Harrison, George A.
|

Harrison and J. Samuel Price, collectors of State taxes for
|
|
 
|
Worcester County, as follows : To Joseph G. Harrison for
|
|
 
|
the sum of twenty-nine dollars and sixty-seven cents ; to
|
|
 
|
George A. Harrison for the sum of eighty-eight dollars and
|
|
 
|
fifty-two cents; to J. Samuel Price for the sum of four hun-
|
|
 
|
dred and fifty-nine dollars and twenty-six cents, for money
|
|
 
|
erroneously paid by them into the State Treasury, the same
|
