said, shall be filed and recorded in the office of the Clerk of

 

the Circuit Court for said county, and a copy thereof, duly

 

certified by said Clerk, shall be evidence in any court of law

tinues to neglect or refuse to perform them ten days after re-

 

ceiving said notice, the County Commissioners shall remove

 

the Treasurer from office and immediately appoint some other

 

person to fill the vacancy for the residue of the term; provided,

 

that nothing in this sub-title of this Article shall be construed

 

to repeal, impair, or conflict with the provisions of the Code

 

of Public General Laws relative to embezzlement; and the

 

Commissioners shall appoint at the expiration of the term

 

of office of a Treasurer, or if removed, at the time of removal.
