CHAPTER 267.

 

AN ACT to repeal and re-enact with amendments Sections 6,

 

7, 9 and 12 of Article 27 of the Code of Public General Laws,

 

title "Crimes and Punishments," sub-title ''Arson and Burn-

 

ing," and to add two new sections to said Article 27, to be

 

numbered and known as Sections 12A and 291D, respec-

 

tively.

 

SECTION i. Be it enacted by the General Assembly of Mary-

 

land, That Sections 6, 7, 9 and 12 of Article 27 of the Code of

Arson.

Public General Laws, title "Crimes and Punishments," sub-

 

title "Arson and Burning," be and the same are hereby re-

 

pealed and re-enacted so as to read as follows :

 

6. Every person convicted of the crime of arson, or as being

 

accessory thereto, shall, at the discretion of the court, suffer

death, or be sentenced to the penitentiary for not more than

 

twenty years; and the wilful and malicious burning of any

 

dwelling house, whether the same shall be in the possession

 

of the offender or in the possession of any other person, with

 

the intent thereby to injure or defraud any person, shall be

 

deemed arson under this section.

 

7. If any person shall wilfully and maliciously set fire to and

 

burn any untenanted or unfinished dwelling house, whether
