CHAPTER 136.
|
 
|
AN ACT to add an additional section to Article 18 of the Code
|
 
|
of Public Local Laws of Maryland, title "Wicomico County,"
|
 
|
to be known as Section 2o8A, under a new sub-title of
|
 
|
"Fraud on Livery Stable Keepers," providing for the pun-
|
 
|
ishment of persons hiring horses or vehicles from livery
|
 
|
stable keepers in Wicomico County to go a certain distance
|
 
|
and using said horses or vehicles for a greater distance.
|
 
|
SECTION i. Be it. enacted by the General Assembly of Mary-
|

sub-title of "Fraud on Livery Stable Keepers," to come in after

Section 208, and to be known as Section 2o8A.
|
 
|
2o8A. If any person shall hire from any livery stable keeper
|

in Wicomico County any horse, mare, gelding or vehicle of

horse beyond
certain

any description whatsoever to go to any certain place, or any
|
limits.
|
certain distance, and shall secretly use said horse, mare, gelding
|
 
|
or vehicle for a greater distance or in going to some other
|
 
|
place with the intent to evade payment for such increased use ;
|
 
|
and shall fail, or refuse to immediately pay the said livery
|
 
|
stable keeper a reasonable compensation for the additional
|
 
|
use of said horse, mare, gelding or vehicle, which additional
|
 
|
compensation shall be rated in proportion to the increased
|
 
|
distance and use, such person shall, on conviction before any
|
 
|
justice of the peace of Wicomico County, forfeit and pay a
|
 
|
fine of not less than five dollars nor more than twenty-five dol-
|
 
|
lars, and upon failure or refusal to pay said fine and costs shall
|
 
|
be committed by such justice of the peace to the jail of Wicom-
|
 
|
ico County for a period not exceeding thirty days ; and in case
|
 
|
the judgment of the justice of the peace is against the accused,
|
 
|
he shall have the right of appeal to the Circuit Court for Wi-
|

case the appeal shall be taken within thirty days after the date
|
 
|
of his conviction.

|
SEC. 2. And be it enacted, That this Act shall take effect
|

from the date of its passage.
