shall become due, and also a sufficient pro rata sum to an

amount not greater than six per centum interest on the said

full power to grant franchises for the public utility, essential

to the proper service of said town of Midland. But any
|
|
 
|
franchise granted by said town shall be and remain subject
|
|
 
|
to recall and redemption by said Council, and said Council
|
|
 
|
shall have the right to purchase the same including all the
|
|
 
|
property and appurtenances and belongings at any time, upon
|
|
 
|
six months' notice, at a cost not to exceed the cost of construc-
|
|
 
|
tion or duplication of the physical property involved, plus a sum
|
|
 
|
of ten per centum upon said cost; the same to be determined
|
|
 
|
by a vote of the Council, to be ratified by the vote of the quali-
|
|
 
|
fied electors of said town, and any franchise granted shall
|
|
 
|
be construed in law to contain and be accepted upon the above
|
|
 
|
conditions. And the Mayor and Council shall provide such
|
|
 
|
compensation for the clerk and treasurer as they may think
|
|
 
|
proper; provided, said compensation shall not be less than
|
|
 
|
twenty-five dollars each per annum. And the Mayor and
|
|
 
|
Council shall provide compensation for the bailiff of said town
|
|
 
|
not exceeding forty dollars per month, and such compensa-
|
|
 
|
tion for collecting moneys as is already provided for in sub-
|
|
 
|
section "Bailiff" of Section 1846. The Mayor and Council
|
|

regulating

shall have the right to pass ordinances providing for licensing,
|
|
sale of
|
taxing and regulating the selling or giving away of any spir-
|
|
liquors.

ituous, vinous or malt liquors, and to license all places when
|
|
 
|
such liquors or either of them are to be used on the premises,
|
|
 
|
whether given away or sold, and all such last-named places
|
|
 
|
within the corporate limits and within one-eighth of a mile
|
|
 
|
thereof in addition to the fees required to be paid to the State
|
|
 
|
shall pay a license fee of twenty-five dollars per annum to the
|
|
 
|
Mayor and City Council of Midland. And it is hereby further
|
|
 
|
provided that no person licensed by the State as a retail dealer
|
|
 
|
to sell liquor in Allegany County, shall sell any fermented or
|
|
 
|
spirituous liquors, or lager beer within the coroprate limits
|
|
 
|
of the town of Midland, or within the space of one-eighth
|
|
 
|
of a mile of said limits, without first having paid to the Mayor
|
|
 
|
and Council of Midland the sum of twenty-five dollars for
|
|
 
|
each and every oyster house, ordinary saloon or place licensed
|
|
 
|
by the State, as a retailer of liquor or lager beer; under a
|
|
 
|
penalty or forfeiture of the license and payment of such fine
|
|
 
|
as may be provided by ordinance, to be imposed by the Mayor
|
|
 
|
acting under his police authority; to enforce the ordinances of
|
|
 
|
the town, for which purpose the Mayor and Council of Mid-
|
|
 
|
land shall have jurisdiction for one-eighth of a mile beyond
