should the Mayor be absent for a shorter time, or vacate
|
|

the office for a shorter period, then and in such case, the
|
|
 
|
clerk shall act as Mayor in the time thus vacated and no
|
|
 
|
election shall be necessary. By and with the consent of the
|
|
 
|
Council, the Mayor shall appoint and employ all agents, ser-
|
|
 
|
vants and employees, not otherwise provided for by law, who
|
|
 
|
may be required for the purpose of said corporation, annually,
|
|
 
|
and shall, by and with the consent of the Council, fix the
|
|
 
|
compensation for said officers. He shall have the power to
|
|
 
|
remove any officers so appointed by him, for cause; he shall
|
|
 
|
have general supervision of the town ; to preside at all sessions
|
|
 
|
of the Council, and have a casting vote; see that the ordi-
|
|
 
|
nances are enforced, and from time to time report to the
|
|
 
|
Council such matters as in his judgment require their atten-
|
|

tion; he shall have power to administer oaths and to certify

the same in all matters pertaining to said corporation, and for
|

the purpose of hearing and determining all cases to which
|

|
the corporation may be a party, he is hereby clothed with
|
|
 
|
all the powers of a justice of the peace, except as to civil
|
|
 
|
cases; he may pass sentence and impose fines for all violations
|
|
 
|
of the ordinances of said corporation, or may imprison, or may
|
|
 
|
both fine and imprison offenders against said ordinances; and
|
|
 
|
to carry out his said powers he is hereby vested with the
|
|
 
|
authority to issue subpoenas for witnesses and compel their
|
|
 
|
attendance by fine for contempt, and shall have the power
|
|
 
|
to include in his fines for the violation of ordinances, the usual
|
|
 
|
costs which are allowed to the justices of the peace and to
|
|
 
|
witnesses and to the bailiff for serving the process, such as
|
|
 
|
are allowed constables under the laws of this State; provided,
|
|
 
|
that no ordinance shall be passed imposing a fine of less than
|
|
 
|
one dollar nor more than twenty-five dollars, nor for a term of
|
|
 
|
imprisonment exceeding thirty days; and provided, also, that
|
|
 
|
all fines imposed and collected shall be paid into the treasury
|
|
 
|
of the town. No order or resolution for the payment of
|
|
 
|
money out of the town treasury shall be valid without his
|
|
 
|
approval in writing. During his term he shall hold no other
|
|
 
|
corporation office, nor shall he be interested in any contract
|
|
 
|
in which the corporation is a party; he shall receive the sum
|
|
 
|
of twenty-five dollars per year for his official services, pay-
|
|
 
|
able annually. Before entering upon his duties he shall take
|
|
 
|
and subscribe before the retiring Mayor, or any justice of the
|
|
 
|
peace, in Allegany County, the oath prescribed in Section 6
|
|
 
|
of Article I of the Constitution of Maryland; annually, on
|
|
 
|
the first Monday in April, he shall report in writing to the
|
|
 
|
Council the receipts and disbursements of the town, and the
