corporation, and in no case against the members of any firm
|
 
|
|
or against the directors, trustees or managers of any cor-
|
 
|
|
poration shall abate, be quashed or set aside under demurrer
|
 
|
|
because less than the whole number of the members of such
|
 
|
|
firm or less than the whole number of the directors, trustees
|
 
|
|
or managers of such corporation have been charged or ar-
|
 
|
|
rested, but such as are charged and have been arrested may
|
 
|
|
be tried, and those who have not been charged or those who
|
 
|
|
being charged have not been arrested may upon being charged
|
 
|
|
and arrested be tried. In trials in the Circuit Court where
|
 
|
|
cases have been removed to said court for jury trial, or in
|
 
|
|
trials upon appeals from justice of the peace, instead of pro-
|
 
|
|
ceeding to trial upon the warrant issued by the justice, the
State's Attorney may in every such case, before the trial begins,
|

charges.

prepare and file in the same any information or charge in the
|
 
|
|
nature of an indictment, and the case shall be tried thereunder ;
|
 
|
|
and if any person or persons be charged as the members
|
 
|
|
of any firm or as the directors or managers of any cor-
|
 
|
|
poration and shall deny that they are members of such firm
|
 
|
|
or are directors, trustees or managers of such corporation,
|
 
|
|
they shall be required to sustain such denials by evidence;
|
 
|
|
and provided, that nothing herein contained shall be construed
|
 
|
|
to prevent the sale of peach or apple brandy, wines or pure
|
 
|
|
and unadulterated apple cider manufactured in Dorchester
|
 
|
|
County from fruit grown therein, in quantities not less than
|
 
|
|
one gallon, by the grower or growers of such fruit upon the
|
 
|
|
premises where the said fruit was grown; provided, that
|

|
nothing herein contained shall be construed to affect any
|
 
|
|
prosecution for now depending violations of the existing laws
|
 
|
|
of the State, or for offenses against the same committed before
|
 
|
|
the passage of this Act.
|
 
|
|
SEC. 2. And be it enacted. That all Acts and parts of Acts
|
 
|
|
inconsistent with this Act be and the same are hereby repealed
|
 
|
|
to the extent of such inconsistency.
|
 
|
|
SEC. 3. And be it enacted, That this Act shall take effect
|
 
|
|
from and after the first day of May, 1904.

|

|
AN ACT to appropriate certain sums of money to the sup-
|
 
|
|
port of sundry schools and charitable institutions in the
|
 
|
|
State of Maryland for each of the two fiscal years ending
|
 
|
|
on the thirtieth day of September, 1905, and on the thir-
|
 
|
|
tieth day of September, 1906, respectively.
