or otherwise any cart or wagon from any resident dealer in

 

such vehicles which said dealer may have in stock at the time

 

of the passage of this Act.

SEC. 5. And be it enacted, That it shall be the duty of any

incorporated town in said county, to apprehend any person

 

violating this Act and to bring him before some justice of

 

the peace in and for said county, and upon conviction before

 

said justice, the party so offending shall be fined five dollars

 

for each wheel of said vehicle which shall not comply with

 

the provisions of this Act, together with the costs of such

 

arrest and trial; and in case of refusal or failure to promptly

 

pay such fine and costs, then the said vehicle shall be seized

 

and sold at a public sale in the same manner as property may

 

be sold for the payment of a common debt, except that no

 

exemption shall be allowed to satisfy the fine and costs of such

 

arrest, trial and sale ; and if for any cause whatever it shall be

 

difficult to apprehend the owner of said vehicle, then the driver

 

with such vehicle or any agent of the owner of said vehicle

 

shall be liable under the provisions of this Act.

 

SEC. 6. And be it enacted. That the aforegoing Act shall be

cents for his services, but if for any reason said notice shall not

 

be given, or not given in the manner herein prescribed, such

 

failure shall not effect the validity of this Act or operate or

 

prevent its taking effect.

 

SEC. 7. And be it enacted, That the ballots cast at said elec-

 

tion shall have printed on them the words, "For Wide Tire

 

Law," with a blank space opposite .the same suitable to receive
