LAWS of MARYLAND.
Washington county, three roads in Allegany county, and to make other
alterations
in and additions to the said act; |
Roads established,
&c. |
II. Be it enacted,
by the General Assembly of Maryland, That the following
roads shall be, and they are hereby declared to be, established and ordered
to be
laid out, surveyed, marked and bounded, in the manner as in the above recited
act is directed, as and for the public market roads in Frederick county,
under said
act, to wit: One road from the west end of Patrick-street, in Frederick-town,
to pass through Middle-town to Washington county line, by Peter Bainbridge's;
one other road from Middle-town to the Washington county line in Turner's
Gap; one other road from the last mentioned road to the Washington county
line in Foxe's Gap, in the South Mountain; one other road from the east
end of
Patrick-street, in Frederick-town, to cross Monocacy at Gomber's ferry,
thence
by William Hobbs's to meet the Anne-Arundel county road leading from the
Baltimore turnpike road towards Frederick-town; one other road from Frederick-town
towards George-town to the line of Montgomery county; one other
road from the county line at Charlton's Gap, in the South Mountain, as
located
and laid down under a former act of assembly, through the said mountain,
then
by the nearest direction through the county to Liberty-town, and from thence
to
meet the Baltimore turnpike road; one other road from the end of the Baltimore
county turnpike road at Winchester-town, through Taney-town and Emmitsburgh
to the Pennsylvania line, near Nicholson's Gap; and one other road from
Liberty-town to William Beatty's plantation, to cross Monocacy at the
ferry
next above the mouth of Israel's creek, to Frederick-town, as located. |
A road in
Washington,
&c. to be laid
out, &c. |
III. And be
it enacted, That a road in Washington county, leading from
Foxe's Gap, in the South Mountain, to the town of Sharpesburgh, and from
thence to Swearingen's ferry, on Patowmack river; and one other road from
Hancock-town, as the old road goes, to Sidling Hill creek, shall be laid
out,
streightened, marked and bounded, as and for two of the public roads of
the
said county. |
Commissioners
continued,
&c. |
IV. And be it
enacted, That the commissioners appointed by the aforegoing
act, on the three first and last mentioned roads in Frederick county, be
and they
are hereby continued as commissioners on the said roads, and that Robert
Cummins,
Abraham Haaf and Alexander Warfield, senior, be and are hereby appointed
commissioners on the road leading from Charlton's Gap through Liberty-town,
in Frederick county, to the Baltimore turnpike road; and that Joshua
Gist, Joseph Taney and John Murray Byard, be and are hereby appointed commissioners
on the road leading from the Baltimore turnpike road through Winchester-town,
Taney-town and Emmitsburgh, towards Nicholson's Gap; and
that William Good, Jacob Hess and Christopher Orendorff, of Washington
county, be and are hereby appointed commissioners on the road leading from
Foxe's Gap to Swearingen's ferry; and that Barnard Johnson, John Donavan
and Patrick Golding, be and are hereby appointed commissioners on the road
from Hancock-town to Sidling Hill creek; and that the said commissioners
shall
exercise the same powers, and do the same duties, as the commissioners
appointed
under the above recited act are authorised and directed to do. |
Justices vested
with powers,
&c. |
V. And be it
enacted, That the justices of the peace in Frederick and Washington
counties, be and they are hereby vested with all the powers which are,
by
the said act, vested in the justices of the county courts of the said
counties; and
that the said justices of the peace, at the time of laying the county levies
in their
respective counties, annually, after this act, shall or may levy such sums
of money
as shall be found necessary, not exceeding the sum limited in the said
counties
by the above recited act are authorised and directed to do. |
Roads to be
cleared, &c. |
VI. And be it
enacted, That all the roads in and by this act established in
Frederick and Washington counties, shall be cleared in the same manner,
