    XX.  And be it further enacted, That all gunpowder brought and conveyed to
the said town of Baltimore, or its precincts, or within the limits thereof, over
and above the quantity of thirty pounds, by any person or persons whatsoever, on
land, shall be carried and delivered immediately to the magazine aforesaid, within
the hours herein after prescribed for attendance at said magazine, under the penalty
of forfeiting at and after the rate of ten pounds current money for every cask or
barrel not delivered to the magazine as above directed, and a forfeiture of the
whole.

 LXIX.

Powder to be

the magazine,
&c.

    XXI.  And be it further enacted, That no person or persons shall carry or
convey in any boat, waggon, dray or other carriage, or in any other manner
whatever, any quantity of gunpowder over and above thirty pounds in weight, in
or through the town or precincts of Baltimore, until the same is first secured and
covered in a good bag or bags, or putting a sheet, sail or other cloth, under and
around it, so as effectually to prevent the same from scattering or sifting out,
under the penalty of ten pounds current money for every cask or barrel, and forfeiture
of the whole as aforesaid.

    XXII.  And be it further enacted, That any justice of the peace for the county
of Baltimore is hereby empowered and required, as often as he shall be informed,
upon oath, of probable cause to suspect any person or persons whatsoever to conceal
or keep, within the said town or its precincts, any quantity of gunpowder
over and above thirty pounds weight, to issue a search warrant to examine into
the truth of such allegation or suspicion, and to search any place whatever
therein.

    XXIII.  And be it further enacted, That all and singular the fines, penalties
and forfeitures, in this act mentioned, shall and may be recovered in any court
aforesaid in this state, with costs of suit, by action of debt or bill of indictment
or information, to be applied towards the expence of paving and repairing the
streets of Baltimore-town.

    XXIV.  And be it further enacted, That the said Maryland insurance fire
company, and their successors and representatives, shall keep a superintendent or
keeper of the said magazine; which superintendent or keeper shall be ready
to attend the same every day (Sundays excepted) from hours of nine in the
morning until two o'clock in the afternoon, and receive all gunpowder delivered
to be stored (on payment of the sum hereafter mentioned) and give a receipt for
the same, mentioning the mark and number thereof.

    XXV.  And be it further enacted, That the said company, and their successors,
shall receive the following storage for all powder delivered at the magazine aforesaid,
to wit:  Five shillings current money for one barrel, and so in proportion
for half barrel and quarter barrel, with liberty of keeping the same in the said
magazine one year for the said price, one half to be paid at the delivery at the
magazine, and the other half at the re-delivery thereof.

    XXVI.  And be it enacted, That the said company shall be answerable and
accountable to the owners of the powder so stored for the same, unless injured or
destroyed from any providential or unavoidable accident.
And to be answerable,

    XXVII.  And, whereas Messieurs Robert Gilmor, and company, Stephen
Wilson, and others, have established a manufactory of gunpowder near Baltimore;
for the encouragement of which, Be it further enacted, That all powder manufactured
at the said manufactory, and belonging to the proprietors thereof, and
stored in the powder-house aforesaid, shall be and is hereby required to be stored
at half the rates herein before directed.
