 LXIX.

Promissory
notes given,
how to be recovered,
&c.

                                LAWS of MARYLAND.

    XIV.  And be it enacted, That in case any promissory note or notes for any
sum or sums of money, shall be given or transferred to the said corporation for
any premium or premiums on any insurance or insurances made by them, the
said corporation shall and are hereby empowered to proceed against the person or
persons so indebted to the said corporation for the recovery of the said sum or
sums of money, in the same manner and form as directed to be done against
persons indebted to the bank of Maryland under an act, entitled, An act to
establish a bank in Baltimore-town.

Capital stock

    XV.  And be it further enacted, That it shall and may be lawful for the said
company, from time to time, to increase their capital stock by the addition of as
many whole shares as shall be judged necessary by the said company, or a
majority of them, holding at least one hundred shares, present at any general
meeting of the said company for that purpose, and the members of the said
company, for the time being, are hereby declared to have the preference of all
other persons for the first thirty days after the determination to increase their
capital as aforesaid; and all proprietors of such additional shares shall and are
hereby declared to be for ever thenceforward incorporated into the said company,
and entitled to every benefit and privilege of the original subscribers.

    XVI.  And be it further enacted, That the president and trustees of the said
company, so soon as they judge it convenient and proper, may purchase, out of
the profits of the said company, a lot of ground, and erect thereon a building fit
and convenient for transacting the business of the corporation.

magazine, &c.

    XVII.  And, whereas it is represented to this general assembly, that the town
of Baltimore, and its inhabitants, are often subject to dangers from the storage
of large quantities of gunpowder within the said town, and to devastation by fire
from a want of proper regulations respecting chimney sweeps; and the prevention
of accidents from such causes being intimately connected with the interest of the
said Maryland insurance fire company, Be it further enacted, by the General
Assembly of Maryland
, That the said company, and their successors, are hereby
authorised to build, erect and complete, a magazine for the storage and reception
of gunpowder, at such convenient place or situation as they shall think proper
and suitable for the safety of the said town, of capacity sufficient to answer the
purpose of storing all such gunpowder as shall be brought to the said town of
Baltimore by land or water, and securing the same from damage or injury, first
obtaining the approbation of the owners of the land on which the same may be
erected.
No person to

    XVIII.  And be it further enacted, That as soon as the said magazine shall be
completed and ready for the reception of gunpowder as aforesaid, and fourteen
days notice thereof given in the news-papers by the said company, no person or
persons whatever shall keep or have in his, her, or their possession, in any house,
building or cellar, within the limits of the town of Baltimore, or the precincts
thereof, any quantity of gunpowder aforesaid exceeding thirty pounds (except in
the magazine) under the penalty of ten pounds current money, and forfeiture of
the whole.

wharfs, &c.
    XIX.  And be it further enacted, That if any gunpowder so deposited as
aforesaid in the magazine aforesaid, be intended for exportation, it shall not be
delivered on board of the vessel intended to export the same (over and above the
quantity of thirty pounds) whilst she remains at any wharf within the town
aforesaid, and its precincts, but shall be conveyed from the said magazine in a
boat well covered up and secured with a sail, canvas or cloth, over the powder
in such boat laden, nor shall it be lawful for any boat, used as aforesaid in
the carriage and embarkation of gunpowder aforesaid, to lay at any wharf within
the said town, or its precincts, with the powder on board, under the penalty of
ten pounds current money, and the forfeiture of the boat and powder therein
contained.
