III. Be it further
enacted, That the act passed at November session, seventeen
hundred and eighty-nine, entitled, An act to amend and alter sundry
parts of an
act of assembly passed at November session, seventeen hundred and eighty-two,
for the more effectual paving the streets of Baltimore-town, in Baltimore
county,
and for other purposes therein mentioned, be and is hereby repealed, also
so much
of an act, entitled, An act for the more effectual paving the streets of
Baltimore-town,
in Baltimore county, and for other purposes, passed November session,
seventeen hundred and eighty-two, as imposes a tax of twelve shillings
and
six-pence on every foot of improved or unimproved lots in those parts
of the
streets of said town fixed on to be paved, and six shillings and three-pence
on
every foot front on the lanes and alleys of the said town paved or to be
paved,
and a tax on drays of twenty-five shillings per annum, be and the
same is hereby
repealed. |

An act repealed,

IV. And,
whereas several streets require to be paved and improved as speedily
as possible, as well on account of the health and convenience of the people
as to
promote the extension and increase of the said town and facilitate
communications
with the country, and it being represented that additional funds will be
necessary
for such purposes; and the general assembly being disposed to encourage
the
growth and welfare of the said town, Be it
enacted, That the said commissioners
may lay and assess, on the taxable property within the said town, annually,
a tax
not exceeding one shilling and three-pence on every hundred pounds assessable
property, and collect the same as directed by the act of seventeen hundred
and
eighty-two aforesaid: Provided always, that the said tax shall not
be laid, imposed
or levied, unless the funds already granted, and to be granted by this
act,
should prove insufficient. |

V. Be it further
enacted, That the said commissioners may and are hereby
empowered to raise, by annual lottery or lotteries, a sum or sums not exceeding
three thousand five hundred pounds per annum, and to dispose of
the tickets and
make all necessary regulations respecting the premises. |

VI. Be it further
enacted, That the said commissioners, with the advice and
consent of the wardens of the port of Baltimore, may and are hereby authorised
to appoint managers for conducting the said annual lottery or lotteries,
who shall
give bond, with good and sufficient security, to be approved of by
the town
commissioners, for the faithful performance of their trusts; which bond
shall be
recorded and lodged with the county clerk; and the commissioners, or any
three
of them, with the approbation of the wardens aforesaid, may be managers
of
the said lotteries, they giving bond and security as aforesaid, to be approved
of,
recorded and lodged, as aforesaid. |

managers, &c. |
VII. Be it further
enacted, That the profits of the said annual lottery or
lotteries be divided and appropriated as follows, viz. Two thirds
of the annual
profits thereof to be paid to the wardens of the port of Baltimore,
for the deepening
and cleaning of the harbour and bason thereof, and one third to the
street
commissioners for the purposes aforesaid. |

VIII. Be it
further enacted, That from and after the first day of January
next it shall not be lawful for any person or persons, other than the aforesaid
commissioners, within the said town of Baltimore, to make, institute, publish,
or cause to be made, instituted or published, any lottery or lotteries
for his, her
or their use or benefit, r to sell and ticket or tickets of any lottery
or lotteries
so made, instituted or published, after the said first day of January;
and any
inhabitant of the said town, offending herein, shall forfeit a sum not
exceeding
five hundred pounds, to be recovered, with costs of suit, by action of
debt,
bill, plaint or information, in any competent court of record, wherein
no essoin,
protection or wager of law, nor more than one imparlance, shall be allowed;
and all fines, so recovered, shall be applied to the uses and purposes
of this
act. |
