                JOHN EAGER HOWARD, Esquire, Governor.

    XII.  And be it enacted, That the said electors shall receive the same per diem
allowance, and itinerant charges, as are allowed to members of the general assembly.

  XVI.
Their allowance.

    XIII.  And, whereas it may happen, that in the election of representatives two
or more persons may have an equal number of votes, and that in the election of
electors, residents of the western shore, six or more persons residing on that shore
may have an equal number of votes, and in the election of electors, residents of
the eastern shore, four or more persons residing on that shore may have an equal
number of votes, Be it enacted, That in each of the said cases, the governor and
council shall determine by lot, from the candidates, who shall be the representatives,
and in the same manner from the candidates for electors residing on the
western and eastern shores respectively, having an equal number of votes as aforesaid,
who shall be the electors for the said shore.

    XIV.  And be it enacted, That if a vacancy or vacancies shall happen in the
representation of this state in the house of representatives in the congress of the
United States, by death, resignation, disqualification or otherwise, the governor
and council shall issue writs of election to the district where such vacancy shall
happen, to fill the same in the manner herein before prescribed.

    XV.  And be it enacted, That in case any of the elections held in consequence
of this act, shall be at a different time from that on which the elections shall be
held for delegates to the general assembly, the sheriffs of the respective counties,
and the commissioners of Baltimore-town, shall have the same allowance for
holding the elections under this act, as by law is given to them for holding the
election for delegates to the general assembly, and which said allowance shall be
paid in the same manner as the allowance for holding the elections for delegates to
the general assembly.

    XVI.  And be it enacted, That the act, entitled, An act directing the time,
places and manner, of holding elections for representatives of this state in the congress
of the United States, and for appointing electors on the part of this state for
choosing a president and vice-president of the United States, and for the regulation
of the said elections, be and is hereby repealed.

                                            CHAP. XVII
An ACT to enable the commissioners of Hanover market, in Baltimore-town,
    to sell part of the said market-house and ground
    thereto adjoining.

14.
    WHEREAS John Eager Howard, William Hammond, William Goodwin,
Lyde Goodwin, and Leonard Harbaugh, of Baltimore county,
by their petition to this general assembly have set forth, that they,
together with a certain Jonathan Hudson, deceased, were appointed commissioners
for the erecting and building a market-house at the west end of the bason of Baltimore-town;
that the funds for the building of the said market-house have been
insufficient to defray the expences thereof, whereby they have incurred, and are
personally liable for, a large debt; and have prayed that they may be empowered
to sell part of the said market-house and the ground adjoining thereto, for the purpose
of discharging the said debt; and this general assembly thinking the prayer
of the said petition just and reasonable; therefore,
Preamble.
    II.  Be it enacted, by the General Assembly of Maryland, That the said John
Eager Howard, William Hammond, William Goodwin, Lyde Goodwin, and
Leonard Harbaugh, and the survivors of them, be, and they are hereby, authorised
and empowered to sell and convey, in fee-simple, for life, years, or otherwise,
such parts of the said market-house, and the ground thereto adjoining, as
will be sufficient to discharge all debts which may have been incurred by the
commissioners aforesaid in purchasing ground for the said market-house, and
erecting the same thereon, and the money arising from such sale shall be by
J. E. Howard,
