    XII.  And be it enacted, That if the said William Campbell shall not accept
his appointment, or if, after acceptance, he shall not give bond, and take the
oath aforesaid, before the twentieth day of January next, or shall die, the
governor and council are hereby authorised and required to appoint a fit and
proper person in his place, who shall have and execute all the authorities and
powers vested in the said William Campbell by this act, such person first giving
bond, and taking the oath aforesaid.

How vacancy
is to be

filled.

    XIII.  And be it enacted, That the said agent be and he is hereby authorised
and required to enforce the recovery of ten per cent. or any less interest, against
any collector, or his securities, on the whole principal originally due from such
collector, where it shall appear to him that the state will otherwise sink a part
of the principal due from such collector.

                                            CHAP. LI.
An ACT for the payment of the journal of accounts.

25.
    WHEREAS it appears by the journal of accounts of this session, that
there is now due from this state the sum of six thousand nine hundred
and fifteen pounds sixteen shillings and three-pence current money;
Preamble.
    II.  Be it enacted, by the General Assembly of Maryland, That the treasurer of
the western shore shall and he is hereby authorised and required to pay the several
persons, their executors, administrators, assigns or orders, or to such of them as
shall offer to receive the same, the several sums of current money allowed to them
respectively, as they appear to be settled and ascertained by the said journal of
accounts, out of any money now in the treasury, or that shall come into the
treasury, subject to the appropriation of the general assembly.

    III.  And be it enacted, That all or any of the public creditors on the journal,
may have their election to receive a certificate or certificates from the treasurer of
the western shore, signed by him, and expressing in the whole of such certificates
the sum of current money due to such creditor or creditors respectively, which
certificates shall be payable to the collectors of taxes due on any public assessment,
or in the treasury for interest due, or composition on certificates, and any collector
may pay any such certificates into the treasury as specie, without any oath
concerning his receipt thereof; or, if any of the said certificates shall not be so
discounted, the treasurer of the western or eastern shore shall receive the said certificates,
and pay the money due thereon to the bearer, out of any money in the
treasury, and subject to be appropriated by the general assembly; and the treasurer
of the western shore shall, on the request of any person having an allowance on
the said journal, and not taking a certificate as aforesaid, retain in his hands, of
the money which shall first come into the treasury, subject as aforesaid, sufficient
wherewith to satisfy such allowance, or the balance thereof, for which a certificate
shall not have been given, and shall pay the same to the person to whom the
same is due, or his order.

    IV.  And be it enacted, That the money now in the treasury, and appropriated
to the erection of light-houses, be and it is hereby appropriated to the payment
of the said journal of accounts.

    V.  And be it enacted, That all money now in the treasury, subject to the
discharge of any former journals of accounts, be and it is hereby appropriated to
the payment of the journal of this session.

    VI.  And be it enacted, That all money now in the treasury, appropriated by
a resolution of the last session to the payment of the civil list and the interest on
the funded debt, be and it is hereby appropriated to the payment of the journal
of accounts of this session.

    VII.  And be it enacted, That so much of the public money owing on duties
up to the first of August last, as will be adequate to the purpose, be and it is
