CHAP. XX.
An ACT to prevent the raising of swine and geese in the town of Vienna,
in Dorchester
county.
The sum of 40f is to be forfeited
to the use of the informer, by any person owning or having the care
of one of these animals, and suffering it to go at large. The said
forfeiture may be recovered before a
single magistrate. Any person may destroy swine or geese going at
large, and, if sued for it, may plead
the general issue, &c. |

An ACT to empower Eleanor Lyon, Henry Lyon, and William Canter, junior,
to sell the real estate therein mentioned of Joseph

CHAP. XXII.
A Bill, entitled, An ACT to enable the commissioners of Baltimore-town
to open and widen Hanover-lane in the said town. |
|
WHEREAS a number of the inhabitants of Baltimore-town,
by their
petition to this general assembly have set forth, that great inconveniencies
arise to the town of Baltimore, and the inhabitants thereof,
from the narrowness of Hanover-lane, leading from Market-street to Hanover-street,
and that great advantages would be derived to the public and the proprietors
of the adjacent lots, provided the commissioners of the said town were
empowered to open and widen the same; and the said petitioners did further
set
forth and propose, that the said commissioners might be empowered to ascertain
the damage sustained by each individual by having the said lane widened,
and
such damage, agreeable to their valuation, to be paid by the persons benefited
by
the same, in proportion to their interest in the adjacent lots, and the
advantage
derived from the opening the said lane; and it appearing reasonable to
this general
assembly that the prayer of the said petition should be granted, |
Preamble. |
II. Be it enacted,
by the general assembly of Maryland, That the commissioners
of Baltimore-town, or a majority of them, be authorised and empowered to
open and amend Hanover-lane, and make it of the same width as Hanover-street,
and the said lane, when so altered and widened, according to the direction
of this act, shall be and is hereby declared to be a public highway and
street;
and the said commissioners are also directed to return a plot, ascertaining
the extent
and limits of the said lane when altered and widened, to the clerk of the
county court of Baltimore, and have the same lodged in the said court,
as part
of the plot of Baltimore-town. |

III. And be
it enacted, That the said commissioners, or a major part of them,
are hereby authorised and required having first given ten days notice of
the time
and intention of their meeting, by setting up advertisements at the most
public
places in Baltimore-town, to take into consideration, and to ascertain,
the damage
which any person or persons shall sustain by having the aforesaid lane
widened and amended, and the amount of the said damages, so ascertained,
to be
returned under their hands and seals, together with the said plot, to the
clerk of
Baltimore county court. |

IV. And be it
further enacted, That the said commissioners, or a major part
of them, on a due inquiry into all circumstances at the time and place
aforesaid,
shall assess and ascertain what sum or sums of money each individual interested
and benefited by opening the said land shall contribute towards reimbursing
and
compensating those who shall be injured by opening the said lane, and the
names
of all the persons, together with the sums of money each shall be obliged
to pay, |
