NOVEMBER, 1696 COURT 85

Ordered by the Court here that the Sheriffe Fetch Thomas Duley out of the
Cage hee being ordered there the Last night upon the Information of John
Smith for Stealing a Saddle. Whereupon Thomas Duley in his proper person
in the Custody of the Sheriffe Came here into Court and the Wittnesses for the
Said John Smith not being here Ready in Court, the Said Thomas Duley by
the Court here was Remitted to the Custody of the Sheriffe aforesaid untill he
Should find good Security for his Appearance the next Court to Answer unto
Such things and Matters as Shall on his Majestys behalfe be Objected against
him for Stealing the Saddle aforesaid and in the meane time to be of good
Abearance.

And now here att this Day (to witt) the 24th day of November Annoque
Domini 1696 Came the Said Thomas Duley and Acknowledged himselfe in-
debted unto our Sovereigne Lord the King in the Just Sume of twenty pounds of
Lawfull money of England together with James Stoddard and Josias Towgood
his Suretyes and the Said James Stodart did Acknowledge himselfe to be in-
debted unto our Sovereigne Lord the King in the Sume of tenn pounds of Like
Lawfull money of England and the Said Josias Towgood in the like Sume of
tenn pounds of like money to be Leavied of their goods and Chatties and tene-
ments Respectivly to our Sovereigne Lord the Kings use if the Said Thomas
Duley Shall not Appeare att the next County Court to be held att Charles
Towne the fourth Tuesday in January next to Answer unto what our Said
Justices Shall then and there object against him as aforesaid and in the meane
time to bee of good behavor as well towards our Sovereigne Lord the King
as all the good people of this province. Ordered by the Court here that the
Sheriffe take the Said Saddle into his [79] Custody and bring the Same to
the next Court to be held here as aforesaid.

And hereupon Came John Smith into Court and Acknowledged himselfe to
be Indebted unto our Sovereigne Lord the King in the Just Sume of tenn
pounds of Lawfull money of England to bee Leavyed on his goods and Chatties
Lands and tenements to our Sovereigne Lord the Kings use if Soe be the Said
John Smith the Said next Court to be held att Charles Towne as aforesaid doe
not procecute his information by him made to this Court against Thomas Duley
as aforesaid.

Mr. Robert Tylor Came on the bench and Satt.

Gillbert Clarke plantiffe: Samuell Williams Defendant.

Prince Georges County Ss. Samuell Williams Late of Prince Georges County
planter was Atteched to Answer unto Gilbert Clarke of a plea of trespass upon
the Case etc.

And Whereupon the Said Gilbert by Cleborne Lomax his Attorney Com-
playneth that whereas the Said Samuell the 22d day of August in the year of
our Lord 1696 att Charles Towne within the Jurisdiction of this Court was
indebted unto the Said Gilbert in the Sume of two thowsand Sixty five pounds
of tobaccoe being as well for divers goods and Marchandizes by the Said Gilbert
to the Said Samuell before that time Sold and delivered as for tobaccoe by the
Said Gilbert paid for the Said Samuell as by a pertickeler Account thereof
here ready in Court to be produced more at Large may Appeare and the Said
Samuell to the Said Gilbert in manner aforesaid being Indebted the Said
Samuell Inconsideration thereof did Assume upon himselfe and to the Said
Gilbert then and there faithfully promise that he the Said Samuell the Said
