thereof to Appeare and Imparle here untill next Court and it is granted unto
him the Same day is given to the plantiffe Likewise.
Att which Said next Court (to witt) the 24th day of November Annoque
Domini 1696 Came the aforesaid partyes by their Attorneys aforesaid and the
Said Allexander Willson prayeth that the Said Thomas Palmer to his Declera-
tion aforesaid may Answer etc.
And the Said Thomas Palmer by William Stone his Attorney defendeth the
aforesaid force and Injury when etc. And the Said Attorney Saith that he is not
Informed by the Said Thomas Palmer his Clyant of any Answer for the Said
Defendant in the plea aforesaid to be given and nothing more thereof Saith
by which the Said plantiffe Remains against the Said Defendant thereof un-
defended.
Therefore it is Considered that the Said Allexander Willson Recover against
the Said Thomas Palmer his damages aforesaid by occation of not performing
his promise and Assumption aforesaid to four hundred pounds of tobaccoe and
alsoe the Sume of two hundred twenty two pounds of tobaccoe to the Said
Allexander Willson at his Request for his Cost and Charges in this behalfe
Expended by the Court here Adjudged etc. and the Said Thomas Palmer in
mercy etc.
John Curry David Murffy and John Fenwick was Sworne as Evidences for
Henry Lowe against Richard Marsham and Ann his wiffe Ordered by the Court
that Henry Lowe pay to Each of the Said Evidences for five dayes Attendance
att thirty pounds of tobaccoe for Each Days Attendance.
[78] Ordered by the Court that John Smith pay unto Thomas Grimes and Ann
his wiffe for Six dayes Attendance being three dayes each and that the Said John
Smith pay unto Samuell Peters for two Courts Attendance being Six dayes
being all Sumoned for the Said John Smith against Thomas Palmer att thirty
pounds of tobaccoe for Each Day.
Ordered by the Court that Michaell Ashforth pay unto Elizabeth Palmer
Servant to Mr. Robert Tylor for five dayes Attendance as She was an Evidence
for him at the Suite of John Deakins att thirty pounds of tobaccoe for Each day
which Comes to 150 lbs. of tobaccoe.
Ordered by the Court here that Francis Durham pay unto Col. John Addison
and Gaven Hambleton for four dayes Attendance for Each of them being
Sumoned for the Said Francis Durham att the Suite of Richard Brightwell att
thirty lbs. of tobacco for Each day.
Ordered by the Court here that the Sheriffe take Michaell Ashforth and put
him in the Stocks there to Sitt dureing the Courts pleasure for being drunk and
abuseing the Justices of this Court.
Uppon the Information of John Smith to the Court here that one Thomas
Duly has Stole his Saddle it is ordered that the Sheriffe putt the Said Thomas
Duley in the Cage and have him before the Court tomorrow morning to Answer
the Same.
The Court Adjournd untill Eight a Clock tomorrow morning and then mett
and Satt as followeth (Viz.):
