undertooke for the Said Jacob Bourneveetch that if it Should happen the Said
Defendant in the plea aforesaid to be in any matter Lawfully Convicted then he
the Said Ignatias Creycroft doe grant for himselfe the debt aforesaid and allsoe
all Costs and damages to the Said Henry Jowles in any manner by the Court
here to be Adjudged to be made and Leavied on his goods and Chatties Lands
and tenements to the use of the Said plantiffe if it Should happen the Said
Defendant pay not the Said Debt and Costs and damages aforesaid nor render
his body to the Custody of the Sheriffe for the Same there to Remaine untill etc.
Edward Ball plantiffe: William Groome Defendant.
Debt: 4500 pounds: of tobaccoe Spetiall baile Demanded.
And hereupon Came into Court John Merriton in his proper person and
under took for the Said William Groome that if it Should happen the Said
defendant in the plea aforesaid to be in any manner Lawfully Convicted then
the Said John Meriton doe grant for himselfe the debt aforesaid and alsoe all
Costs and Damages to the Said Edward Ball in any manner by the Court here
to be Adjudged to be made and Leavied on his goods and Chatties Lands and
tenements to the use of the Said plantiffe if it Should happen the Said Defendant
pay not the Said Debt and Costs and Damages aforesaid nor render his body to
the Custody of the Sheriffe for the Same there to Remaine untill etc.
Henry Lowe plantiffe: Richard Marsham and Ann his wife Defendants.
Calvert County Ss. Richard Marsham Late of Calvert County Marchant and
Ann his wife were Atteched to Answer unto Henry Lowe Esq. of a plea of tres-
pass upon the Case. And Whereupon the Said Henry Lowe by Samuell Wattkins
his Attorney Complayneth that whereas about the 10th day of Febuary 1693
[1694] att Calvert Towne within the Jurisdiction of this Court In consideration
that he the Said Henry Lowe at the Spetiall Instance and Request of her the
Said Ann whilst She was Sole would Lend to her the Said Ann a horse which
he the Said Henry Lowe was then possessed of, of the vallew of one thowsand
Eight hundred pounds of tobaccoe to ride a Journey upon She the Said Ann
whilst She was Sole (to witt) the day yeare and place aforesaid did Assume upon
her Selfe and to the Said Henry Lowe then and there faithfully promise that She
the Said Ann the Said Horse to him the Said Henry Lowe would Faithfully Re-
turne in the Same plight and Condition that She the Said Ann Received the
Same from him the Said Henry Lowe the day and year aforesaid And the Said
Henry Lowe in Fact Saith that he the Said Henry Lowe did the [69] day year
and place aforesaid att the Instance and Request aforesaid Lend the Said horse
to her the Said Ann whilst She was Sole in manner and forme aforesaid Not-
withstanding which the Said Ann whilst She was Sole her promise and Assump-
tion aforesaid made Little Regarding but minding and fraudulently Intending
him the Said Henry Lowe of his horse Craftily and Subtilly to deceive and
defraud She the Said Ann whilst She was Sole or the Said Richard and Ann
Since the Espowsalls between them had and Cellebrated or either of them the
said horse in manner and forme aforesaid Lent have have not Returned to
him the Said Henry Lowe Although often demanded but the Same horse to
Returne have denyed and Refused and Still do denye to the damage of the Said
Henry three thowsand Six hundred pounds of tobaccoe and thereupon he
bringeth this Suite.
