[66] And the Said plantiffe haveing Issued out two writts against the defendant
boath which was by the Sheriffe of Prince Georges County Returned that the
Said Defandant was not to be found in his balywick upon which on part of
the Said plantiffe it is testified here in Court thatt the Said Defendant hath
Elloined himselfe out of this province Whereupon the Said Joshua Cecell in
his proper person prayeth an Attechment against the goods Chatties and
Creditts of the Said Richard Hulse as well for the Said Sume of one thowsand
pounds of tobaccoe due by Accompt as aforesaid as alsoe the Sume of four
hundred and four pounds of tobaccoe his Cost and Charges in this behalfe Laid
out and Expended According to Act of Assembly in Such Cases made and
provided etc. And by the Court here it is granted unto him.

Attechment Debt 788 Cost 360 Layed in the hands of Mr. Thomas Greenfeild

And the Said John Murth by Henry Bonner his Attorney Cometh and de-
fendeth the force and Injury when etc. and Craved Lycence to Imparle till
next Court and it is granted unto him And whereupon the Said plantiffe
prayes Securyty may be given by Reason the Said John Murth is goeing out of
this province and it is granted unto him.

And whereupon Came James Bigger into Court and Acknowledged himselfe
to be Securyty for the Said John Murth that in Case the plea aforesaid Should
happen to goe against the Said John Murth that then the Said James Bigger
will pay all Damages and Costs that Shall by the Court be Adjudged against
the Said John Murth.

Then did the Court Adjourne for one hower and then mett and Satt as Fol-
loweth (Viz.)

Present. Mr. Thomas Hollyday, Mr. Robert Bradley, Mr. William Barton, Mr.
John Wighte, Mr. William Tanyhill, Mr. Robert Tylor, Comisoners.

The Grand Jury Came in and presented thire presentments to the Court
Whereupon the Court ordered the Said Jury to have Creditt att Charles Tracys
for four hundred lbs. of tobaccoe.

Command is given to the Sheriffe of Prince Georges County that he Cause
