of Tobacco it being for Rume and Suger Sold and Delivered unto the Said
John Murdock as by a perticular account thereof her ready in Court to be
produced more att Large may appear And the Said John to the Said Thomas
being Soe indebted as aforesaid Inconsideration thereof did assume upon him-
selfe and to the Said Thomas then and there faithfully promise that he the
Said John the Said Sume of two hundred Eighty two pounds of Tobacco to the
Said Thomas when he Should be thereunto requested would well and truely
Content and pay Nevertheless the Said John his promise and assumption not
regarding but mindeing and Fraudulently intending him the Said Thomas in
this behalfe Craftily and Subtilly to deceive and defraud the Said Sume of 282
pounds of Tobacco or any Part thereof to the Said Thomas hath not paid
although the Said John to doe the Same by the Said Thomas afterwards the
Day and place aforesaid was often therunto requested but hath hitherto
refused and Still doth refuse to the Damage of the Said Thomas of five hundred
lbs. of Tobbacco and thereupon he bringeth this Suite.

The Plantiff by Joshua Cecell his attorney Prayes Speaciall baile to the action
abovesaid alleadging that the Defendant was Departing this Province and it was
Granted unto him.
Whereupon came Archibald Edmundson in his Propper person and under-
tooke for the Said John Moordock to pay The Debt aforesaid and Cost there-
upon and Desiered that Judgement might be Entred against him for the Same.
Therefore it is considered that the Said Thomas Hollyday Plantife doe recover
against the Said Archibald Edmundson Speaciall Baile of the Said John Mur-
dock Defendant as well the Sume of two hundred Eighty and two pounds of
Tobacco his Debt aforesaid as allso the the Sume of two hundred and twenty
pounds of Tobacco Costs of Suite to the Said plantiff of his assent by the Court
here adjudged and that the Said Archibald Edmundson be in mercy.

John Murdock Late of Prince Georges County Merchant was Atteached to
answer unto Joseph Jackson and Company of London Merchants of a plea of
Tresspass upon the Case.
And whereupon the Said Joseph and Company by Joshua Cecell his Attorney
Compleineth that whereas the Said Joseph and Company the day of
in the year of our Lord 1698 att Charles Towne within the Jurisdiction of this
Court Stood indebted unto them the Said [513] Joseph and Company in the
Sume of three hundred Ninety Six pounds of Tobacco it being for Rume and
Suger Sold and Delivered unto the Said John Murdock as by a perticular ac-
count thereof here ready in Court to be produced more att Large may appear

said inconsideration thereof the Said John did assume upon him Selfe and to
