And the Said Timothy Mahony by William Stone his Attorney comes and de-
fends the force and Injury when etc. and Prayeth Lycence thereof to imparle here
untill the next Court comeing and it is granted unto him the Same day is given
to the Plantive Likewise. Att which day (to witt) the 20th day of September
Annoque Domini 1699 here came as well the Said John Lowther Plantiff as the
Said Timothy Mahony Defendant by their attorneys aforesaid and the Said John
Lowther Prayeth that the Said Timothy Mahony to his Declaration aforesaid may
answer.

And the Said Timothy Mahony by William Stone his Attorney comes and de-
fends the force and Injury when and Saith that he did not assume in Manner and
forme [aforesaid] and Putts himselfe upon the Court. William Stone.

And the Plantiff allso. Joshua Cecell.

The Court haveing read and Fully understood the Alligations of the Parties on
both Sides and the Wittnesses on both Sides being fully heard by the Assent of the
Parties aforesaid where it appeared to the Court that the Said Defendant had an
account against the Said Plantiff for the Lone of a horss Severall months at a
Certaine rate per day and for 112 pounds of poark at 3d per lb. amounting to
One Thousand thirty one pounds of Tobacco which the Court was pleas [ed] to
allow of in barr of Part of the Said Sume the Defendant was then Sued for as
abovesaid.

Therefore it is considered by the Court that the Said John Louther recover
onely the Sume of Seven hundred and Seven pounds of Tobacco the ballance of
his Debt Sued for. as allso the Sume of two hundred fifety two pounds of Tobacco
Costs of Suite to the Said Plantiffe of his Assent by the Court here Adjudged and
the Said Timothy Mahony Defendant be in Mercy.

Willsons Executors Plantiff: Brothers Executor Defendant

Kathrine Willson and Joshua Cecell Executors of the Last Will and Testament
of Jonathan Willson Deceased brought his Majesties Writt against Elisha Sedge-
wick Executor of the Last will and Testament of Robert Brothers Late of Prince
Georges County Deceased of a Plea of Tresspass upon the Case it being for two
Thousand Six hundred thirty nine pounds of Tobacco Due for Ordinary Ex-
pences as by Declaration filed appeareth etc.

Whereupon the Court Considering that the Debt abovesaid was for Ordinary
Expences Twas Ordered that the account Should be auditted and Nominated
Mr. William Huchison and Mr. Robert Bradley to regulate the account and to
returne their auditt this Court.
