next Court and it is Granted unto him the Same Day is given to the Plantives
Likewise.

Att which day (to witt) the 20th day of September annoque Domini 1699
here came as well the the Said Thomas Taney and uxor as the Said James
Moore by their Attorneyes aforesaid and the Said Thomas Taney and Jane his
Wife prayes that the Said James Moor to their Declaration aforesaid may
answer.

And the Said James Moor by John Meriton his Attorney comes and defends the
force and Injury when etc. and Saith that he did not assume in manner and forme
and putts himselfe upon the Court. John Meryton.

And the Plantiff allso. Joshua Cecell.

The Court haveing read and Fully understood the Alligations of the Parties on
both Sides and the Wittnesses on both Sides being fully heard by the assent of
the Parties aforesaid etc.

Therefore it is Considered by the Court that the Afforesaid Thomas Taney and
Jane his Wife Administratrix of the Said Henry Truman recover against the Said
James Moor Defendant as well the Sume of Twelve hundred and three pounds of
Tobacco their Debt aforesaid as allso the Sume of four hundred Sixty and Eight
pounds of Tobacco Costs of Suite to the Said Plantives of their assent by the
Court here adjudged and that the Said James Moore Defendant be in mercy.

John Lowther Plantiff: Timothy Mahony Defendant

Timothy Mahony Late of Prince Georges County Planter was atteached to
answar unto John Lowther of a Plea of Tresspas upon the Case. etc.

And whereupon the Said John by Joshua Cecell his Attorney Complaineth that
whereas the Said Timothy at Severall dayes and times between the 21st day of
Aprill in the year of our Lord 1698 and the 30th day of November in the year of
our Lord 1698 att Charles Towne within the Jurisdiction of this Court Stood
indebted unto the Said John in the Sume of one Thousand Seven hundred thirty-
one pounds of Tobacco being as well for Credditt given as allso for Severall goods
wares and Merchandizes by the Said John Sold and Delivered to the Said Timothy
as by a Perticular account thereof here ready in Court to be produced relation
being thereunto had may more att Large appear And the Said Timothy to the
Said John in manner aforesaid being indebted inconsideration thereof did assume
upon himselfe and to the Said John the Said 30th day of November in the year of
our Lord 1698 att Charles Towne aforesaid faithfully promise that he the Said
Timothy the Said Sume of 1731 pounds of Tobacco when he [501] Should be
afterwards thereunto requested unto the Said John would well and truely Content
and pay Nevertheless the Said Timothy his promise and Assumption soe as afore-
said made Little regarding but mindeing and fraudulently intending him the
Said John in this behalfe Craftily and Subtilly to deceive and defraud the Said
Sume of 1731 pounds of Tobbacco or any part thereof to the Said John hath not
paid although the Said Timothy to doe the Same by the Said John afterwards the
Said 30th day of November 1698 and att Severall other days and times Since att
Charles Towne aforesaid have been thereunto requested but the Same to Pay hath
denyed and Still doth denye to the Damage of the Said John of 3000 lbs. of
Tobacco and thereupon he brings this Suite etc.
