Trumans administratrix: Plantiff: James Moore Defendant
James Moor Late of Prince Georges County Carpenter was atteached to
answer unto Thomas Tany and Jane his Wife administratrix of all and Singu-
lar the Goods Chatties and Credditts which ware of Henry Truman Late of
Callvert County Inhoulder Deceased att the Time of his Deceas of a plea of
Tresspass upon the Case etc.
And whereupon the Said Thomas and Jane by Joshua Cecell their Attorney
Complaineth that whereas the Said James in the lifetime of the Said Henry
that is to Say from the year of our Lord 1690 untill the 18th day of September
in the year of our Lord 1695 att Callvert Towne that is to Say att Charles Towne
within the Jurisdiction of this Court Stood indebted unto the Said Henry the
Sume of two Thousand three hundred and Eleven pounds of Tobacco being
as well for the ballance of account as allso for Divers Licquors Dyetts Lodgeings
ordinary accomadations by the Said Henry in his life time Sold and Delivered
to the Said James as by a Perticular account thereof here in Court Produced
Relation being thereunto had may more att Large appear And the Said James
to the said Henry in manner aforesaid being indebted inconsideration thereof
the Said James did assume upon himselfe and to the Said Henry then and there
faithfully promise that he the Said James the Said Sume of 2311 lbs. of Tobacco
unto the Said Henry when he Should be afterwards thereunto requested would
well and truely Content and pay And the Said Thomas and Jane in Fact Saith
that the Said James in Persuance of his Promise and assumption soe as afore-
said made did pay and Sattisfye unto the Said Henry in his Life time the Sume
of of 708 lbs. of Tobacco part of the aforesaid Sume of 2311 lbs. of Tobacco but
as to the Sume of 1603 lbs. of Tobacco residue of the Said Sume of 2311 lbs. of
Tobacco the Said James his promise and assumption aforesaid Little regarding
but mindeing and fraudulently intending him the Said Henry in his Life time
Craftily and Subtilly to deceive and defraud he the Said James the Said Sume
of 1603 lbs. of Tobacco residue as aforesaid to the Said Henry in his Life time
or to the Said Jane whilst She was Sole to whom Administration of the Goods
and Chatties of the Said Henry Since his Death hath been Leagally Committed
or to the Said Thomas and Jane or to Either of them Since the Espowsalls
between them had and Celabrated hath not paid Although the Said James to
doe the Same by the Said Henry in his Life time afterwards the Said 18th day
of September in the year of our Lord 1695 and by the Said Jane whilst She was
Sole After the Death of the Said Henry and by the Said Thomas and Jane Since
the Espousalls between them had and Celabrated Att Callvert Towne that is to
Say at Charles Towne within the Jurisdiction of this Court hath been often
thereunto requested but the Said Jane the Said Sume of 1603 lbs. of Tobacco
residue as aforesaid to Pay to the Said Henry in his Lifetime or to the Said
Jane whilst She was sole after the Death of the Said Henry or to the Said
Thomas and Jane Since the Espowsalls between them had and Celebrated hath
denyed and Still doth denye to the Damage of the Said Thomas and Jane of
3000 lbs. of Tobacco and thereupon they bring this Suite etc. And they bring
here into Court the Letters administration etc. that it may the Plainer appear
etc.
