a Perticular account thereof here in Court produced relation being thereunto
had May more att Large appear And the Said James to the Said Jane whilst
she was Sole in Manner aforesaid being indebted Inconsideration thereof did
assume upon himselfe and to the Said Jane whilst She was Sole then and there
Faithfully Promise that he the Said James the Said Sume of 518 lbs. of Tobacco
unto the Said Jane when he Should be afterwards thereunto requested would
well and truely Content and Pay Nevertheless the Said James his Promise and
assumpption soe as aforesaid Made Little regarding but mindeing and fraudu-
lently intending her the Said Jane whilst She was Sole in this behalfe Craftily
and Subtilly to deceive and defraud the Said Sume of 518 lbs. of Tobacco or
any Part the Said Jane whilst Shee was Sole or to the Said Thomas and Jane
or to Either of them Since the Espousalls between them had and Celabrated
hath not Paid althou[gh] the Said James to doe the Same by the Said Jane
whilst She was sole afterwards the 16th day of January in the year of our Lord
1695 [1696] and by the Said Thomas and Jane Since the Espousalls between
them had and Celebrated att Callvert Towne that is to Say at Charles Towne
within the Jurisdiction of this Court was often thereunto requested, but the
Said James the Same to pay to the Said Jane whilst She was sole or to the Said
Thomas and Jane Since the Espowsalls between them had and Celabrated hath
refused and Still doth refuse to the Damage of the Said Thomas and Jane of
1000 lbs. of Tobacco and thereupon they bring this Suite etc.

To one Dyett, 2 pottles of Syder, 1 Gallon of Ditto, 1 pottle of Strong beer,

one pottle of Quince Drink, 1 Dyett, 1/2 pint of wine, 1 Dyet and a Pottle

of Syder, Six pottles 1 Quart of Syder, 1 Dyett, 1 Lodgeing .............. 438

And the Said James Moore by John Meryton his attorney comes and defends
the force and Injury when etc. and pray Lycence thereof to imparle here untill
the next Court comeing and it is granted unto him the Same Day is given to
the plantifs Likewise.

Att which day (to witt) the 26th day of September Annoque Domini 1699
here came as well the Said Thomas Tany and uxor as the Said James Moor
[499] And the Said Thomas Taney and uxor by their attorny aforesaid Prayeth
that that the Said James Moor to their Declaration aforesaid might answer.

And the Said James Moore by John Maryton his Attorney comes and de-
fends the force and Injury when etc. and Sayth that he did not assume in man-
ner and forme and puts himselfe upon the Court. Meryton.

And the Plantiff allso. Joshua Cecell.

Whereupon the Court haveing read and Fully understood the alligations of
the Parties on both Sides and the Wittnesses on both Sides being fully heard
by the Assent of the Parties aforesaid etc.

Therefore it is Considered by the Court that the afforesaid Thomas Taney
and Jane his wife recover against the Said James Moore Defendant as well the
Sume of five hundred and Eighteen pounds of Tobacco their Debt aforesaid as
allso the Sume of two hundred Eighty two pounds of Tobacco Costs of Suite to
the Said Plantives of their assent by the Court here adjudged and that the Said
James Moor be in Mercy.
