Sterling his Debt due for Damage upon the Protested bill of Exchange Togather
with the Sume of Sixteen Shillings Sterling the Damages upon the above pro-
tested bill of Exchange att twenty pounds Sterling per Cent as allso the Sume
of two hundred Eighty Eight pounds of Tobacco to the Plantife of his assent
for his Cost and Charges of Suite by the Court here adjudged and the Said
Nicholas Sporne Defendant in mercy.
Thomas Lucas desiers to have the Following bill of Exchange recorded.
Maryland May the 5th day 1699. Exchange for 3 pounds
Twenty days after Sight of this my first bill of Exchange my Second and third
of the Same Tenor and date not Paid Pay or Cause to be Paid unto Thomas
Luckus or his Ordar the full Sume of three pounds Sterling money of England
make good payment to content and Place it to the account of your Freind and
Servant to Command. Sollomon Stimpson.

Edward Battson Plantiff: Thomas Padgett Defendant
Thomas Padgett Late of Prince Georges County Otherwise called Thomas
Padgett of Prince Georges County Planter was Summoned to answer unto
Edward Battson of a Plea that he render unto him the Full Quantity of Six
Hundred pounds of Good Large bright Pickt and Guild Tobacco and Caske to
Conteine the Same which to him he oweth and unjustly deteineth.
And whereupon the Said Edward in his Propper person Saith that whereas
the Said Thomas the 26th day of June in the yeare of our Lord God 1696 att
Charles Towne within the Jurisdiction of this Court by his certaine bill or
wrighting Obligatory Seald with the Scale of him the Said Thomas and here in
Court produced whose Date is the Day and year aforesaid did acknowledg him-
selfe to owe and Stand Justly indebted unto the Said Edward in the Full
quantity of Six Hundred pounds of good Large bright Pickt and Guild Tobacco
and Caske conteineing the Same to be Paid to the Said Edward Battson heires
Executors Administrators or assignes upon his then Dwelling plantation att or
upon the tenth day of October next Ensueing the Date of the Said Obligation
to the Payment whereof well and truely to be made he the Said Thomas bound
himselfe his heires Executors administrators firmely by these presents Nottwith-
standing which the Said Thomas the Said Sume of Six Hundred pounds of
Tobacco though often demanded to the Said Edward hath not paid but the
Same to Pay hath denyed and Still doth denie to the Damage of the Said Edward
of 1200 lbs. of Tobacco and thereupon he brings this Suite.
Pledges John Doe, Richard Roe. Edward Battson propria persona.
And the Said Thomas Padgett in his Propper Person Cometh and defendeth
the force and Injury when etc. and Saith that he cannot Gainesay the Action of
the Said Edward Battson Plantiff nor but that the bill aforesaid is his deed Nor
but that he oweth the Said Edward Battson the Said Six hundred pounds of
Tobacco in forme [483] as the Plantife above against him hath declared.
Therefore it is considered that the Said Edward Battson Plantiffe doe recover
against the aforesaid Thomas Padgett defendant as well the Sume of Six Hun-
dred pounds of Pickt and Culled Tobacco his Debt aforesaid and allso the Sume
of two hundred and forty pounds of Tobacco to the Plantiff of his assent for his
cost and Charges of Suite by the Court here adjudged and the Said Thomas
Padgett Defendant in mercy. Cecett Executio till the tenth day of November
