OCTOBER, 1699 COURT 555

Whereupon all and Singular the Premisses by the Court being Seen and under-
stood it is Considered that the Said John Bennett Pay unto our Sovereigne Lord
the King as a Fine the Sume of twenty Shillings it is also Considered that he pay
unto Edward Willett the master of the Said Clifford for the trouble of his house
the Sume of Eight Hundred pounds of Tobacco and the Said John Bennett to
continue in Custody till the Fine, the Damages and all Fees Paid to the Officers
of this Court, and to give good Security for his good beheaviour and appearance
the next Court. [Fine]

James Moor Plantiff: Thomas Taney Defendant

Thomas Taney Late of Prince Georges County Gentleman was atteached to
answer unto James Moore of a Plea of Trespass upon the Case etc.

And whereupon the Said James by William Stone his Attorney Complaineth
that whereas the Said Thomas the thirteenth day of August in the year of our
Lord 1695 att Charles Towne within the Jurisdiction of this Court Stood
Indebted unto the Said James in the Sume of two hundred twenty four pounds of
Tobacco as by a Perticular account thereof here in Court Produced Relation
being thereunto had may more att Large appear, And the Said Thomas to the
Said James in manner aforesaid being indebted in Consideration thereof did as-
sume upon himselfe and to the Said James then and there faithfully promise that
hee the Said Thomas him the Said James the Said Sume of two hundred twenty
four pounds of Tobacco when he Should be thereunto afterwards requested
would well and truely content and Pay Nevertheless the Said Thomas his Promise
and assumption Soe as aforesaid Made Little regardeing but mindeing and
fraudulently intending him the Said James in this behalfe Craftily and to deceive
and defraud the Said Sume of 224 pounds of Tobacco or any Part thereof to the
Said James hath not Paid allthough the Said Thomas to doe the Same by the Said
James afterwards the Day and Place aforesaid was often thereunto requested but
the Same to pay hath denyed and Still doth denye to the Damage of the Said
James of 448 pounds of Tobacco and thereof he brings this Suite etc.

And the Said Thomas Taney by Joshua Cecell his attorney cometh and de-
fendeth the force and Injury when etc. and Prayeth Lycence thereof to Imparle
here untill the next Court comeing and it is Granted him the Same day is given
unto James Moor Plantife Likewise.

[471] Att which day (to witt) the 26th day of September Annoque Domini
1699 here came as well James Moor Plantiffe by John Meryton his attorney
aforesaid as the Said Thomas Taney by his attorney aforesaid and the Said
Defendant by Joshua Cecell cometh and Defendeth the force and Injury when
etc. and Saitn that he did not assume in manner and forme and putts himselfe
upon the Court. Joshua Cecell.
